Can a Lawful Permanent Resident apply for a fiance Visa

Hi All,

I need a little help. I am a GreenCard Holder. I have a girlfriend in a foreign country that I would like to bring to US. What is my best option? Am i eligible to apply for K-1 or any other visa for her?

A green card holder can not apply for K-1 VISAs.

shows what you can and can not do. Either you have to wait for your citizenship or they get here someway else and get a GC.

Green Card holders can apply for their spouse only - get married and then apply. It can take years, but when you get your citizenship, you can upgrade your petition.

If you can't wait that long, or aren't sure you want to get married yet, she'll need a different (non family based) visa - work, student, visitors etc.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

You are not eligible to apply for a visa for her at anytime (an alien must apply for there own visas)... however, you are eligible to petition for her only as a spouse... in order to petition for a fiance(e) you must be a USC....

Usually, it is quicker to wait for citizenship on your part and then file for a spouse or fiance visa. The quickest would be for her to enter on another type of visa.

AOS

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08
