Hi all. I have really enjoyed the collective knowledge from this site, so thanks to everyone! First time poster here.

It's getting to be the end of the year, which I remember from last year means -- tax questions! Yay!

My situation:

I am a USC, my wife is an Ecuadorian national CR-1 applicant.

I successfully maneuvered the beurocracy to file jointly with my wife, a nonresident alien treated as a resident for tax purposes,

W7 processed, ITIN received, got my refund last year. Yay!

In the meantime, my son was born. He is 7 months now. When he was just a couple of weeks old, we took him to the consulate to get his nationality established. The consulate in Guayaquil apparently sent my SSN application for my son to the embassy in Quito, which then asked me for deficient documents, which I sent them. I tried to get confirmation that the application was sent to SSA office in the US, but never could get a reply from them despite repeated emails.

I still have not received my son's SSN card. It has been about 6 months now. Should I go in to a social security office? Do I need translations of his birth certificate? I have his passport and official copies of his birth certificate in Spanish. The wife has the consular report of birth abroad certificate. Maybe I should snatch it while I'm there.

I also wonder if anyone knows if my son lives here for the last few days of the year, does he qualify as a dependent for taxes?

According to a document from my employer, he needs to be here for half of the year to qualify. That would be a bummer.

I've tried searching, but am having a hard time finding search terms to yield the info I need on this one.

I'm just guessing, but I think the application might have been sent to the Federal Benefit Unit in Costa Rica, but after 6 months the application should have been processed and received the child's card.

The only way to find out if the child has been assigned an SSN is for you to go into an SSA office or Card Center, since SSA doesn't give out SSNs over the phone.

A U.S. citizen needs proof of age, identity and U.S citizenship. The parent that signs the application also needs to provide proof of identity. An unexpired U.S. passport could be provided as proof of identity and U.S. citizenship. The birth certificate would be the proof of age and if needed the SSA office would have it translated. You could provide your driver's license as your proof of identity.

If the child has been assigned an SSN and is a U.S. citizen, proof of identity for the child and you is all that's needed to apply for a replacement card.

I went to the SSA office here with original birth certificate and passport of my son in hand. I should have his card in two weeks. It seems the embassy in Quito filed it in the garbage. :angry: I'm glad I expended all that effort to get them the documents they asked for. :blink:

Well, my wife's interview is on monday. I sure hope everything goes well!
