Hi,

My husband has a final exam scheduled on the time and day he may take his oath (12/16/09). We haven't recieved the notice yet, but other Sacramento applicants recieved oaths on the next available day so we are anticipating he will likely recieve that date. Has anyone had to reschedule their oath? Was that a painful process?

We don't want to delay the oath too long for a variety of reasons. He is contemplating asking the professor for a postponement on the exam should the letter come but those are not always granted either.

December 31, 2004-Resubmitted application

February 28, 2005-Notice of Reciept

March 28, 2005-Appointment to pick up EAD

April 16, 2005-Fingerprinting

April 27, 2005-Interview in Sacramento-A Success!!

August 20, 2009 Mailed application for citizenship to Phoenix

August 25, 2009 Recd package in Phoenix

August 28, 2009 Date of NOA

Hi,

We don't want to delay the oath too long for a variety of reasons. He is contemplating asking the professor for a postponement on the exam should the letter come but those are not always granted either.

It shouldn't be too painful to reschedule an oath ceremony if there is a conflict. The reason for the conflict is certainly a legitimate one and one that might be difficult to reschedule. If the professor is willing to let him write the exam at another date (he might be more willing to let him write it a day early than postponing several days late - just a suggestion) that is great, but if your husband needs to write that exam at the time, USCIS is quite flexible about re-scheduling oath ceremonies.

When you get the oath ceremony date, contact USCIS and explain to them that due to the examination conflict your husband would like to request the next available oath ceremony date instead. They should be able to accommodate the change and give you a new date. Good luck.

In our long, as yours, history with the USCIS, that has always been the first priority as if you are not here legally, nothing else matters? Other stuff always comes up, but how important is that other stuff if you are not permitted to stay here? Tell this to your professor as my wife told this to her employer.

Nick, this is a citizenship oath - while very important, yes, one's immigrant status is not dependent upon making the scheduled ceremony. This is an optional not a required stage of the process. He will remain here legally whether he becomes a US citizen or not. He will not be kicked out of the country because he isn't a citizen yet. The oath ceremony is quite easy to postpone and I have read of a number of instances where someone couldn't make the first date they were offered and rescheduled for later dates. It really isn't a life or death situation anymore and the OP can definitely try and make this one work more to their convenience. The USCS will work with them on this, trust me on that.

Hi Elishav,

In answer to your question:

Yes, you husband can postpone his oath (other VJers have done it too). As long as you don't mind a delay in having the oath later than expected, and aren't in too much of a hurry to get citizenship, then you're fine there. Be prepared though, that the wait for a new oath date could be quick, or it could be a lot later. As long as you're willing to take this risk, especially more so since you've come so far in the process...

Alternatively, can he ask the professor to postpone the exam until after the oath or do the exam before the oath? Try explaining it to them that this is important, and that your husband doesn't want to miss such. After all, an exam can be done at almost any time, but an oath ceremony can't. I'm sure if the professor is understanding (and smart enough to understand about such too...lol...), they might be able to accomidate for such for your husband.

Thank you so much for answering my questions. You confirmed what I feared: that they postponement could set us back longer than a month. I am really concerned he could be postponed later than a month, for a couple of reasons(employment being one of them, as he is graduating and the feds are the only ones hiring civil engineers anymore).

If it comes, I am going to tell him to beg for an alternative time and date for his exam. The professor emigrated to the US in the 1980's from China, so he may he a little bit more lenient. He knows all our pain ;)
