Dear Members,

I have been granted US Citizenship 6 months back,with support and consent from my spouse, now I want to sponsor my sister's

family back in india for Green card in the family based immigration - 4th category.

I want to Do it on my own, as the costs of going through a law firm or attorney are right now not an option for me.

I have gone through many immigration portals and their valuable suggestions, but i still have some doubts.

I understand that I need submit the following forms:

From my side USC :

Form I-130 - Petition for Alien Relative

Form I-864 - Affidavit Of Support

Form I-864A - Contract Between Sponsor and Household Member

Form DS-3032 - Choice of Address and Agent for Immigrant Visa Applicants

Form DS-230 - Application for Immigrant Visa and Alien Registration (Part 1 and 2)

Form G-325A - Biographic Information

1) should i submit 3 separate sets of forms one each for my sister, my bro-in-law and one for my 4 year old nephew ?

2) should my spouse also sign and fill 3 separate sets ?

3) how much should i pay $355.00 filing fee X 3 = $ 1065 ?

4) should my spouse also pay $ 1065 ?

5) Are photos required to be submitted for F-4 category from both petitioner and applicants family?

6) should me & my spouse submit a copy of our Income Tax return ?

Regarding Form I-864 - Affidavit of Support,to Provide Adequate Financial Support Evidence what should i submit? we have an

own home, 2 cars, some stocks and cash in hand.

Is there a Standard List of Required Supporting Documents to Prove Brother/Sister Relationship ?

my sister and me have the same father & mother's name in our respective Birth Certificates,passports,PAN cards,Educational

Certificates, bank passbooks,as a nominee in bank fixed deposits and L.I.C policies etc.

my sister and her spouse have their marriage certificate, each others names in their passports and child birth certificate

and child passport.

We also have lots of photos of all our family since child hood, family functions and sister's holiday trips to the USA.

Sister and her spouse also have Police Clearence Certificates, nephew doesnt need one i suppose.

What documents should my sister and her family submit from Indian side?

Do they have to pay any fees at the american embassy / consulate in india?

are photos of all the 3 family members needed? any specifications for the photo?

Any specific forms to be signed by them?

do they have to get all their certificates/documents photocopied and Notarised in India?

I apologise for this lenghty posting. I wanted to be specific so that members can get an idea of what my problems are.

It takes about 10-11 years for a US citizen to petition a sibling from India for a visa. The number of visas for siblings are limited. Each year, there are 10 times as may people who want them as there are visas available. So that is why siblings have to wait 10-11 years for visas.

You need to file Form I-130, proof of your US citizenship, your birth certificate (showing your name and your mom's name), your sister's birth certificate (showing her name and your your mom's name), and any documents showing a name change differing from the birth certificates. Your birth certificates will show your relationship as siblings through a common mother. Marriage certificates will show any name changes. Everything needs to be translated into English. Submit copies. DO NOT SEND ORIGINALS. You do not need the other the other forms.

There is no basis in the law for you to submit one for your bro-in-law or nephew. Your bro-in-law and nephew are included as derivative beneficiaries on the petition for your sister.

2) should my spouse also sign and fill 3 separate sets ? No one can file for an in-law. There is no basis in the law for your husband to file applications for your sister or her family.

3) how much should i pay $355.00 filing fee X 3 = $ 1065 ? One fee of $355 for your sister.

4) should my spouse also pay $ 1065 ? No. See answer to #2.

5) Are photos required to be submitted for F-4 category from both petitioner and applicants family? No. See the Guides.

6) should me & my spouse submit a copy of our Income Tax return ? No. You will not be asked to submit this for a long time. When your sister is eligible for a visa (in about 10-11 years), the NVC will then ask for your income tax info and the I-864.

Any specific forms to be signed by them? No. You sign the I-130. The I-130 shows that you are qualify to petition for your sister. It will get approved anywhere between 1-9 years. The day USCIS receives the I-130 will be your sister's Priority Date (PD). Look at the Visa Bulletin to see if her PD is current. Only those with PDs before those listed are eligible for visas. Once the PD is current, your sister will be asked to send in the DS-3032. You will be asked to submit Form I-864. Your husband at that time files Form I-864(a). Then your sister and her family apply for visas using Form DS-230. do they have to get all their certificates/documents photocopied and Notarised in India? Notarizing is not need. All you need is a copy of her birth certificate with an English translation. You could do the translation and include a translation block that you are competent to translation from the foreign language to English. Do a search of this forum, you will find many of these translation blocks. There is not a specific required block.

Thanks a Lot for giving specific answers. I am really clear with the process now.

both our birth certificates are in english, so that should take of it.

I know it takes 10-12 years, but recently i have noticed in the monthly visa bulletin, that family 4th category is moving fast @ of 2 years waiting in priority date for each year progressing, at least for india.

so i presume if my sister is lucky she might get her date in 5 years ( rather than 10 )

my nephew is 3 1/2 yrs old, so hopefully he should not age out. all this filing is for him & his future studies.

The current priority date is a moving target. Besides being a hard limit on the total number of visas issued in each category each year, there is also a limit on the percentage of visas issued in any single country. Only a few countries reach the percentage limit each year, which is why the priority dates for those countries is much farther behind the dates for all the other countries combined. These countries are referred to by USCIS as "oversubscribed". Due to a variety of reasons, the number of people who are "subscribed" (have an approved I-130 pending) can change dramatically over time. I suspect the economy and unemployment rate in the US may be causing some people to cancel or postpone their plans to immigrate, which may be causing the current priority date to progress faster than usual. In other words, the rate that people are coming in from an oversubscribed country will remain constant, but when people waiting in front of you are leaving the line then your wait grows shorter.

I wouldn't rely on this current trend to continue indefinitely.

thanks a lot for ur reply,

I heard from people that percentage of visas issued in any single country is around 7%.

i have no other option but to file file an I - 130 for my sister's family, in the process, i have an intuition, things WILL take a different turn for the better
