I-134 Affidavit Of Support

Hi fellow VJers,

We have run into what could become an issue in regards to the letter from him employer. He works for a company that employs 50,000 people, all HR is based in the Phillipines. So getting a letter is going to prove to be a nightmare as nobody in the office he works in will sign a letter stating he has been there for just on 10 years.

So I guess my question is this: is the letter crucial for the affidavit is there is sufficient evidence to show he has been there for a substantial amount of time?

I have read the guides & I am still as baffled as to what we do from here.

Timeline

My husband and I never included a letter from his employer, we used his tax returns, w-2s and 6 paystubs up to the most recent we could get. We didnt have a problem and his taxes don't even reflect his annual income, half his income isn't taxable. His taxes show he makes 10k and he makes 40k. They didnt even second look his papers. But they did look over his paystubs and YTD (year to date) statement.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

An employment letter isn't crucial to the I-134, pretty much for the reason(s) you point out; they can be nearly impossible to get from every employer.

The best supporting evidence remains:

  • Tax Return(s) and supporting documents (W-2's, 1099's etc) or IRS Tax Transcript(s) (whichever you prefer)
  • Pay-stubs
  • Supporting evidence of any assets you may be using to supplement any shortfall in income (if applicable)

Thanks guys -- we had sort of come to that conclusion but just wanted it clarified considering the guides and the government websites don't mention that part of it.

He has more then enough evidence for the rest...so we are good to go :) He is off to the bank on Monday (US Time) to get the process moving for the bank papers.

Yes, getting anything in writing out of the Philippines can be very hard. My spouse had to jump through major hoops just to get a copy of her transcripts from Manila Central UNiversity. We had to send someone in person to get it after we faxed a request.

What is the reason the employer won't give you a simple employment letter?
