hi everyone.. do i really need my husband's signature when i file my I-751? because we are separate right now and i don't think if he's gonna sign it anyway.. i wanna file solo, would it be possible? or doi really need to file with my husband's signature? pls.. anybody has gone with this same situation pls. help me... thank u.

read the instructions for the form, they state how and when to file solo. i think its some sort of waiver! sorry but i cant tell you more there.

Actually you don't have to wait anymore for the divorce to be final before you file. You can file when you're separated - they will later issue an RFE for the divorce documentation.

But I guess you better be sure first that you are indeed going to divorce. Otherwise, you'll have to file as married and show documentation that you still are married (and entered into the marriage in good faith).

If you file for divorce, you have to prove you entered the marriage in "good faith" and provide documents that prove you were "merging your lives" this means utility bills in both your names, lease and/or rental agreement in both your names, etc...

If you are not divorced, then you need to initiate divorce proceedings in order to adjust status. You can submit your I-751 without the divorce decree, but you will still get the RFE for it at a later time and you STILL even then have to prove you entered the marriage in "good faith"

USCIS understands that marriages do not always work out, but they will not take your word over paperwork. You have to have documents that support you in this.
