Dear Visa people,

Yes...we are so close it hurts.

My fiancee (Argentina) tried for a tourist visa and was quickly shot down when they discovered that she had a pulse and was under 70 years old. It seems nobody except rich business people and senior citizens get Tourist Visas out of Argentina. Any way...

She was refused a Tourist Visa and has the black stamp on her passport to show for it. Yikes...

The DS-156 form, question 31. asks "Have you Ever Been Refused A U.S. Visa and yes she has. Then later on under Question 38 they ask "Have you ever been refused admission to the U.S. or....and so on and so forth..."

My question is whether we answer Yes or No. If one answers Yes then the visa may be refused based on a specific law.

I am confused.... Of course if we answer No and the correct answer is Yes we are most likely screwed too...

What a mess.

17 Oct 2005: Sent in K-1 package via USPS Express Mail

20 Oct 2005: Recieved NOA1

25 Oct 2005: Check Cashed

22 Nov 2005: Forgot to copy all pages of divorce decree

24 Nov 2005: Accepted new package

28 Nov 2005: Approved NOA2...off to NY for VISA...amazingly fast.

Of course you need to say yes! she was denied, and lying will just make matters worse. I don't see what being denied a tourist visa would have on your case...as far as I am concerned it shouldn't have any bearing....but then again I would never be so bold as to say I know for sure.

Now as far as the second question, has she ever been denied entry in the US. I took that as if she has ever been at the port of entry and turned back.

Rough situation, but I will guarantee if you lie they will know.

Just be honest, as the previous poster said they will know if you lie, just put yes to the part where she was refused a visa, this should not have any bearing on weather you are refused your visa or not. As your fiancee never got the visa then No she was not refused entry at Poe.
