Hey there,

just a couple of things now that we're on to the affidavit:

1. So i understand you have to be 125% over the poverty line, but my fiancee lives with her parents at home n we will live with them for a while, so where does that put us?

Do they recognize this and ease up on us financially seeming as we're going to be living with her parents?

But we don't come under the next poverty line for more people int he house, cause the parents obviously work for themselves and have jobs right?

2. For a co-sponsor, is it still ok if they are behind of their tax returns? or is that something they need to be on top off?

You're going to need a co-sponsor if you're not employed and don't have the assests. Living with the folks doesn't mean anything. The parents need to pay up their taxes if they're going to sponsor you.

You're going to need a co-sponsor if you're not employed and don't have the assests. Living with the folks doesn't mean anything. The parents need to pay up their taxes if they're going to sponsor you.

1. They don't care where you live. No, they do not "ease up"

2. What do you mean? If they have not filed tax returns, that is a problem, now and for the AOS.

You can use a co-sponsor, his parents or others, but they will have to submit the same documents and be able to qualify to support you and any other dependents in their household. Only one person's income counts for the I-134 and one person must make enough to qualify. If his parents file joint tax returns only one income counts. However the other spouse does not count in the family size, they are not a "dependent", they are an adult US citizen and are presumed to make their own living, whether thay have an income or not.
