Its been a long and hard year and a half and just got denied (221g) for no having a common language. I know she is not fluent but we could talk on the phone all the time.

The embassy suggested to fly to her get married and apply for k3 visa.

I don't think I can wait another year and a half. I know she is very frustrated with the system and wants to call it quits.

The question I have is what do I have to do.

The embassy is going to send back the application.

Do I have to do anything or just wait for the denial letter.

Thanks...

The only reason to do anything would be if the two of you wish to live together in the USA. If you do, I would plan a marriage trip but then skip the K3 and take the CR1 visa route. Once you're married, if you don't have the final denial letter from USCIS, simply withdraw your I-129F petition.

I'm sorry to hear your news. I thought your spouse can get through the Embassy via an interperter? A friend of mine went Kenya and did the K3 route. Maybe you should go route? And how do all these other immgrants I hear can barely speak English get in here! My neighbor is from Vietnam and I swear can't speak a word of English - or refuses.

Good luck...

no need to withdraw your petition, if you are filing another one for the same beneficiary. let USCIS decide what to do with it. that is what we did, and our cr1 was approved in 2 months. we sent in the i130 and a month after the noa1 we received a letter from uscis that it was ok for us to refile if we choose to do so.

sorry for your situation. if you plan on continuing the relationship in the usa, i recommend looking at the pinned topic on the middle east north africa forum. there is some valuable information.
