Please help me bring family back to the USA after deported by father :(

Hello everyone,

I have ae cousin of mine who was immigrated here almost two years ago and then this summer her father took it upon himself to ship her back to their country, claiming that she is not behaving right. she has all her documents but the worse part is, he sent her away and kept all her documents and she has been in the country for five months now and i am wondering if there is anything i can do to help bring her back here.

she was seventeen when her dad sent her away and about to graduate high school, now she is eighteen and god knows IF he ever send back for her, she'll be in her 20's and will have to struggle getting GED to get back to school.

so please any suggestion or anyone been to this situation? :unsure:

Report taking of the documents to the local police and then get a new set of documents. If she had any copies of the GC or knows her number of GC and SSN she could go to the American embassy and request a transportation letter. Then file for new GC through I-90 ($380).

The father 'shipped' his LPR daughter back without her US green-card because 'she was not behaving'? Are both mother and father in the US but the father sent the daughter back to Haiti? Who is this minor child living with in Haiti? Or did the father send the daughter back to the mother?

####### kind of parent is that? Sorry, this is not to bash anyone's parenting, but how do you take your child's green-card away and send her back to the home country because she's not behaving? USCIS can revoke a green-card...the father doesn't have the right to 'revoke' his daugter's green card just because he doesn't like her behavior.

If she's been out of the country for five months, she's getting close to the 6 month mark. (More than 6 months out of country without advance parole may result in loss off status). If anything is to be done, it should be done quickly.

So she was a minor when she got sent away, maybe she was really misbehaving and this is the parent's way to taking her out of a 'bad' environment? Just playing the devil's advocate. Maybe she really is better off with her mother for now.

She's 18 now, she isn't a minor anymore and can take care of her documents by herself. She can come back and shoud do it quickly.

The unfortunate part will be the relationship between father and daughter, that's another story. Her father can't interfere.

Timeline

Just because her father kept her documents does not mean that he took away her legal status as well. If she was a permanent residency when she went back to her home country, she will still be a legal resident now. All she needs to do is get a new green card which can be easily obtained with the US embassy. And now that she's 18 years-old, her father has no legal rights over her, she's an adult now and can do as she pleases.
