So, my wife and I are sooooooo close to completing the bureaucrat quagmire that is moving to America legally and then we received an RFE last week.

To quickly re-cap, I entered the country about 4/5 months ago on a K-1 (fiancé) visa. We promptly got married and applied for AOS.

Thus far, we had an RFE a few months back regarding the I-485 which we sorted out and now we have another one regarding the I-693.

I have already completed my biometrics and received a year long work permit a month ago.

With the AOS, we didn't submit an I-693, we instead submitted a DS-3025 which is the vaccination supplement I received when I got my medical done in London earlier this year.

The question I have is this;

The new RFE we have states;

"I-693 Medical Examination: There is no record of a complete medical exam in your file. Please submit a properly completed and signed Form I-693, Medical Examination of Aliens Seeking Adjustment of Status. The medical examination must be completed by a physician who is on the list of Civil Surgeons approved by USCIS"

I submitted my brown envelope to the TSA when I arrived in this country in spring time of this year. This, I assume, contained my medical record.

Has the USCIS now lost my medical info or is the quote above merely just a pre-written statement regarding vaccination AND medical clarification?

I have read in another thread that this is a common occurrence and the recourse seems to be to contact your Congressman/woman.

Any advice would be helpful!

Pretty common for them to lose your medical. I would recommend just having another one done and submitting it. Yes you can fight it if you are willing to take the time to do so.

We just had another one done for about $250. BTW this was his third medical since we started the process At least I know he has no diseases and is healthy

It happened to us.... we bit the bullet and got it redone... at least one other VJ member "fought" it and they eventually found the medical (after getting congressional help).... it took some time and thus we decided it was not worth the delay...

I have the original receipt from my medical earlier this year PLUS the chest x-ray in my possession.

Having to do the WHOLE medical again is such an F-ing pain.........

......yes, but as others have said, far, far less of an F-ing pain than spending God knows how long trying to track down the original.

Just suck it up, and get it done again (consider it the lesser of two evils).

Thanks for the replies but I'm not going to pay for another medical - I would go to my Congress Persons Office first!

Anyway, the issue is resolved. I rang the USCIS place and FINALLY got to speak to someone who managed to put 2+2 together, which was;

I came to the US on a K-1 Visa. It's MANDATORY to have a full medical before it is issued. I have 6 months to use that Visa then 3 months to get married once I entered the country, so that's a MAXIMUM of 9 months between my medical and AOS application.

The lady explained they ONLY needed my vaccination record and that's all.

My wife and I never sent the proper I-693A form in, we merely sent the DS-3025 form which is the vaccination form I received when I did my medical in London. We thought we would try and 'wing it' as I read some people have been successful with just sending in the DS-3025.

Needless to say, I'll contact a USCIS approved surgeon after the holidays to get them to transfer the information from my DS-3025 to an I-693A.

Man, I can't wait for this immigration stuff to end, it's driving me nuts..... :bonk:

Best wishes! I hope you find someone who'll do it for you cheaply. We're "winging" it too. The RFE we received didn't have anything to do with the I-693 (yet). I can appreciate the "driving me nuts" statement. Looking back the K-1 was a piece of cake! :lol:

Yes, if the information line person gave you that info, it is NO DOUBT accurate and you won't have any more problems. :unsure:
