I'm wondering if anyone has filed for an I-131 and received it, and then when traveling back into the US, was refused entry. The only reason why I ask this is that my husband (he's Canadian) did receive permission, but noted in the document received (I-512L, Authorization for Parole of an Alien Into The United States) that "Parole is not admission into the United States" and that "Parole into the United States is not guaranteed".

Naturally, he's worried that he won't be let in after returning home for Christmas. Are these points in the document just legalese, or has anyone experienced a situation where they were granted the I-131, and then not re-entry? Wondering...

Unless you are a US Citizen, entry is never guaranteed. That's all they are saying.

However, you posted this in the CR1 forum. Your profile says you're applying for the N/A visa. We don't have a forum for that but the CR1 and IR1 visa holders don't need advance parole.

Facts are cheap...knowing how to use them is precious...

CR1 is eligible to get I-551 stamp upon entry, no need for parole.

With K1 you do all the paperwork etc when you get to the U.S. - with CR1/IR1 you do all of it beforehand so you are a PR as soon as you cross that border with your visa.

The Advance Parole will always be granted, whether or not the person should use it.

The most common way people are caught out by this is when they have sufficient overstay to incur a ban on re-entry... that may be forgiven in an Adjustment of Status via Immediate Relative (AOS for a spouse) but if the person is still waiting on their AOS (thus needing the AP) they are still in the "danger zone". CIS used to put up a warning on the website around busy travel times to remind people.

Of course, if they do something that makes them inadmissible while they're out of the country, and that comes out to the officer at the return journey, AP won't overcome other inadmissibilites either.

There's also a legal distinction between 'admission' & 'parole' but it doesn't matter/apply to most people.
