I asked this question before but have not received response, and now i hope its not to late!

I live in AZ and sent my N400 90 days before my 5 years of residency date.

Now when checking out posts on this forum many people got their interview before 90 days!

Now if my interview is scheduled before 02/15/10 then i will not have 5 y of residency at my interview!

Am i right? Can this happen?

If you do recieve your interview before the 90 days, they delay your oath until you qualify.

December 16, 2009-Oath at 8:30AM Merry Christmas!!!!!

They will let you interview, but they WILL delay the Oath. For how long - depends on the DO. Some lucky guys got their Oath scheduled for the day after they become eligible, some (most) in a week or 2 after eligibility date, and some (like myself) 2 months (!!!) after. It seems that people from DOs which offer same day Oath can suffer the most. That happened to me and several other folks. Since for same day Oath offices you basically fall out of their normal process, they push you all the way to the back of the line.

Here is my timeline:

N-400 Submittal - end of July

Interview - 15th of October

Eligibility date - 24th of October

Oath date - 10th of December

Basically, if my interview was 10 days later, I'd likely get same day Oath and be completely done by the end of October. But since these idiots scheduled my interview just 9 days earlier of my eligibilty date, I got an Oath date of December 10th, and that after writing and calling our Senator.

Since for same day Oath offices you basically fall out of their normal process, they push you all the way to the back of the line.

I really hope my oath does not follow the same path as yours, I also had my interview at the Fairfax office (yesterday) but for some reason they could not give me same day oath due to my zip code (I am not entirely sure why, but I had been hoping to get same day oath since I applied based on marriage and had applied after almost 4 years). So now I am waiting for an oath letter, I hope I do not have to end up calling a Senator.

WOW thats fast! Hows that even possible!

I live in PHX and sent my N400 to PHX office which is 3 miles from my house and still nothing!

But yeah i live in PHX and sent my N400 to PHX office at E Skyharbor Circle (3 miles from my home) 7 days ago via fedex and still no NOA!

I wonder how some people in this forum from Oregon and Ohio got their NOA 5 days after mailing N400 to phx office?

I wonder how some people in this forum from Oregon and Ohio got their NOA 5 days after mailing N400 to phx office?

When we filed our I-751 it was sent to Nebraska, then moved to California where it got misplaced. From WI, we sent our N-400 also to Nebraska and it stayed there to be returned to St. Paul, that went smooth, but if we were to file today, would be sent to AZ. What I was saying is that the USCIS is always changing the locations where these applications are processed at that can cause delays whenever they do that.

I don't know about AZ, but in WI today, it's deer hunting time, everyone takes off, so not much gets done. Could be the people processing your N-400 also took off for this week, so I wouldn't worry about it.
