Okay here's the story! My husband and I filed a K-1 visa last year and then had to eventually file and 601 waiver and then got denied. The lawyer did all the paperwork for us and we just signed the paperwork. We have looked into what to do to start this process over again now that we are married, but are a little confused. I now live in the Uk. I quit my job, left my family and freinds and moved here. The wedding was just last weekend and it turned out to be beautiful!!! A very lovely day. Now we want to file the K-3. So I start by filing the I130 and the G325A's - right? And where do I send them? Is it the American Embassy in London? If so what is the Address....and do I have to live here for a few months to file first? I have been here 2 months on a fiance visa and next week I am getting my "Leave to Remain" visa. We hope to only be here a year if everything goes okay this time. Basically my husband was raised in the states since he was a child and then his mom passed in Mar of 05 and he got stopped coming back through at the airport. Could everyone please help us through filing all the paperwork......

Hello. Congratulations on your marriage! :)

When you say you are going to apply for a K-3 do you mean you want to file DCF in London? Because it's not the same as the K-3. The DCF guide pinned at the top of this forum should answer your questions to get you started. Good luck :)

The K3/ CR1 process is described in detail in the FAQ.

There is a seperate section here for waivers, I would also go and have a look at www.immigate2us.net. London has a high success rate for waivers.

You will need a US Residency address and by the sounds of it a co-sponsor.

Sounds like you are not eligible to DCF.

I do have a mailing address in US and my parents could be our co-sponsor there. So should I apply straight through to London or do I have to through the Nebraska Servicing Center like before. I have read all the links and guides and I am so confused.

I thought since I am now living in the UK I would file directly to the American Embassy in London???

Our lawyer had told me to file through London as well....when we rendered our services....not sure what to do???

Well unless they have recently changed the rules, you need Indefinite Leave to Remain to be able to file with the London Consulate.
