DOES THIS SEEMS LIKE A REJECTION?

Hello people,

I've called the US EMBASSY awhile ago, since it's been almost 6 weeks and we haven't heard anything since the last interview date of my parents (10/13/09). My mother was asked to send in NBI with her aka since her birthname was different from the name that she's using (MARILYN to MERLYN). SO she did and she send it in. But when she got her NBI, instead of NO DERAGATORY RECORD, it says NO CRIMINAL RECORD.

When I send her first NBI record it says, NO RECORD ON FILE (which I sent together with her DS-230 to NVC). Then I asked her again to get another one since she might need a new one for her interview, so she did, and found out that she has a traffic violation which happened in 1991, and she never got the subpoena since that was the time when the Mt. Pinatubo erupted and my parents left our business in Olongapo and went back to Pampanga where we really live, but that was settled out of court before my parents even moved back to Pampanga. Since they don't have an interview nor a medical yet, they went ahead and processed it thru courts and took them 2 months to settle it and got her clearance. (It was a blessing in disguise that my dad's chest xray was put on a 2 month sputum exam which turned out to be negative)

So when my mom got her clearance she went ahead and got her NBI and was able to get it, but without her aka name, so when they had the interview, she was not able to show it. Instead got another NBI with an aka, which she submitted the next day, after the interview.

I've been calling 1-2 times per week for an update but they keep giving me the same answer which was wait for 6 weeks. Then I called a while ago and was told that Embassy sent a letter to the applicant last November 16, 2009 reagrding NBI QC.. the person that I was talking to as not able to give me a clear answer, and she said that she was just reading what was on the computer. She was not even sure if the letter came from embassy or from NBI.

Can anybody here give me their 2 cents?? I am really lost here.

I also petitioned my dad, but he originally told the consul that he wanted to wait for my mom too, but since he got a sputum test, St Lukes told him that he has to leave the country before December 23, 2009 or else he will undergo all the medical exam again. You think that I can tell them to go ahead and issue my dad's visa so he can be here prior to December 23? This is very stressful for me, since I wanted my parents to be with me and celebrate holidays together after a long time.

I don't know about your situation but can tell you mine and see if that helps you. My fiance was missing the NBI police clearnce from Taiwain. She got it the other day and HAND DELEVIERD it to the us embasy. She got told to go hom and visa will be on it's way. If I read correctly you sent it in? so who knows who has that paper. could it be the mail that is very bad in that country? Could it be lost on somebody's desk as i read here somebody once handed it in and it sat at the counter for 2 weeks. You might want to follow up that htey received this paper for sure?

I know it is stressfull as I am trying to get my Grace here by xmas too. It is going to be close depending on how long the visa takes to get to her place and i can get a ticket for her.

Correct me if i'm wrong but i know i read somewhere here that those who got that "No Derogatory Record" remark should go to NBI to get a letter from them stating about that case,or i guess it's the USEM who'll send a letter to them(NBI).If it's already been resolved,they will inform the USEM,maybe they're still waiting for the reply from NBI and once they have it,i bet they'll issue your mom's visa.as for your dad,once his medical exam expires,he'll need to re-do it again.

NBI CLEARANCE: Applicants aged 16 years and older must have a valid Record Clearance for Travel Abroad Purposes from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name, married name, and any aliases or nicknames ever used, including different spellings of all names ever used. An official letter of explanation from the NBI is required for any notation of “No criminal record”, "No pending criminal case” or “With derogatory record.” NBI is located along Taft Avenue in Manila. You may contact NBI at (632) 523-82-31 to 38. For immigration purposes, an NBI clearance is considered valid only for one year from the date it is issued.

MY mom got the letter Monday afternoon, and it says

"This is regarding your immigrant visa application with the U.S. Embassy. The National Bureau of Investigation police certificate (NBI clearance) submitted in support of your visa application indicates that a case has been previously filed against you in Philippine court. To enable us to determine whether your case will have effect on your eligibility to receive an immigrant visa, we require a written explanation from the NBI indicating the resolution of the case. In this connection, you will need to undergo an interview with the NBI personnel. You may report to the Quality Control Section of the Identification and Records Division (NBI-IRD), Room 108, NBI Compound, Taft avenue, Manila, for the interview. Please look for Mr. Francisco Donozo or Jim Maniquis and present this letter. the NBI-IRD office is open Mondays through Fridays, except holidays, from 8-2pm. We will continue processing your case as soon as we receive result of your interview with NBI"

So my mom had her NBI interview awhile ago (Wednesday, Manila time) and was told that she has no problem since the case was already resolved, she submitted all her documents so the NBI said that she's ok. And that US Embassy are the one who gets the NBI report every Friday. Anyway, my mom asked an estimated date when she will be able to get her visa and NBI said that she will be lucky if she will get it in a month's time after Embassy gets the report.

Since St. Lukes advised my dad to leave the country by December 23rd, I will be faxing a letter to Embassy to expedite my dad's visa and not to wait for my mom.. that was told to me when I just called US Embassy.
