Hi guys,

I'm ready to send my affidavit but I still have a question regarding my husband's taxes. In 2007 he did not file taxes for 2006 because he was in school and he only made $1000 when he worked for a couple of months at Fridays. He was also a dependent and his mom claimed him. So what kind of letter should he write for the I-864. The I-864 says: A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statementand/or evidence describing why you were not required to file. Has anyone ever written one of these letters?? Thank you in advance!

File I-864 with the "Most Recent Tax Year".

Is now a US Citizen immigration completed Jan 12, 2012.

We're using a joint sponsor for the affidavit. I thought that although you only need the most recent (last year2008), you also have to show that you have filed your taxes for the last three years. Is that right?

"Most Recent Tax Year" = 2008 return NOT 2007.

File I-864 with the "Most Recent Tax Year".

25. Federal Income Tax Information.

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

http://www.uscis.gov/files/form/I-864.pdf The instructions says you mus provide recent year return or transcripts, it says you "MAY" include the other years.

Yes. The embassy in Peru wants all 3 years of tax returns. I know what USCIS says, but I would go with the embassy's rules because they will be ultimately making the decision whether to approve or deny the visa. I would take a copy of his mom's tax returns to show that she claimed him that year because he was in school, just in case they ask for it.

They are also going to want the last 3 years of tax returns for your co-sponsor, FYI.

You can also get the tax transcripts, I brought those as well.

I sent my affidavate of support to my wife with the tax years 2007, 2006, 2005....I didnt file in 2008 because I was in Peru the whole year. At the interview the guy just looked at my 2007, and used that for my income. Then asked if I was working now. I said yes, and that was then end of it.
