Hello Ladies and Gentlemen,

My wife filed a I130 peition back in May 2009, became USC on October 18 2009. (our receipt date was MAY 21 2009)

She called USCIS on October 19 to upgrade the petition from F2A to Immediate relative. Next day she received an email from USCIS saying they need a copy of her naturlization certificate to be faxed which we did next day October 20 2009.

Until now we did not receive any confirmation letter from USCIS saying the case has been upgraded. and they are saying we have to wait 45 days before making and further inquiry.

I have two questions:

1/ how long does it take for I130 to be processed?? shall I count 5-6 months from MAY 2009 when the I130 was filed (i.e this month) OR 5-6 months from the time it was upgraded??

2/ Does it worth it at this time to file for I129F for K-3 VISA? will this cause any delays in processing the I130 petition if I did file for this now?

I would expect the I-129F to not be advantageous to you due to the big difference in possible filing dates.... the downside is that the I-129F could actually slow down the I-130

So, what do you think I should do now? Just wait and pray?

I was reading others posts who upgraded their petitions,, they received a confirmation letter within few days after calling the USCIS !!

now I'm waiting for one month and didn't hear anything ! Is this normal ?

Will they issue a new priority date for me OR it will remain the same as MAY 21 2009 !!

If it remained the same (May 21 2009) when shall I expect my case to be completed (under normal circumstances)

You are from a region where name checks are known to slow things down. Filing the 129F won't hurry that up. The downside to the 129F is the extra fees if it does get approved first and the waiting for your green card. You might eliminate some waiting up front only to pay for it on the back side

Aha, OK.

Now, is my I130 will be processed based on my initial filing date (Receipt date : May 21 09) .. or my I130 upgrade date (? October 21 09) ?

According to USCIS CSC processing time for I130 is approx 5 months .. i.e they should be processing applications received in June 2009 !!

Any comments?

Well, 45 days isn't that far away now...don't worry about the online status...mine hasn't changed either from a year ago...looks as tho I'm not even in the US! Can you print a report from the fax machine to confirm that they received the fax?

Well, 45 days isn't that far away now...don't worry about the online status...mine hasn't changed either from a year ago...looks as tho I'm not even in the US! Can you print a report from the fax machine to confirm that they received the fax?

I do have a report from my fax machine confirming successful delivery of the fax :'(

Are they processing now I130 received in May 2009? does upgraded petition gets new priority date the same day it was upgraded or retains the original receipt date?
