Hello everyone,im just new in here.I do really need some advice about my situation right now.My visa was approved as CR1 visa and we will be having our 2nd year anniv. this january 15.My husband dont want me to pursue on that interview bec. he told me about his income tax problem which he just found out recently which he said its like 6 yrs he haven't paid that and could not support me if I go there, thats why he told me to move on and forget about him,live a life without him and this is through e-mail.Even there are others who told me that there might be something else why he don't want me to go there bec. he might already have someone else.What I did,I pursue that interview without his knowledge and w/out any financial assistance coming from him and when I e-mailed him that my visa was approved he told me that i might get deported if were not living together and my visa and green card might taken as well and it will take 3 to 5 yrs to divorce him other than that he also said to his email that he had an affair w/ other woman 5 months ago and hes doing the right thing for this girl for the childs sake which he said its a younger friend of his aunt.Because I was so upset and kinda mad for what he told me before like moving on and dont even telling directly on how,so what i keep telling him I want it in legal matter and when I e-mailed him also about my visa that it was approved that my reason why I pursue on that is for us to have divorce in the united states which I think it was not a right words for me to say but I just said that bec. I do really hate him for what hes been telling me about moving on even if I keep explaining to him that Im his wife and whatever hes going through w/ his income tax problem we will help each other but for him its always no.

Im really in pain upto now coz I couldn't believed that he done this things to me by cheating on me,he doesn't even find ways for us to talk according to his email hes ashamed to talk to me for what he did.Forgiveness is always open but I want to know the whole truth thats why I want to go there.

My questions right now are :

1)what if my husband will file for a divorce right now do i still have the chance to go there coz im planning to go there after our 2nd yr anniv so that the status of my visa will change into 10 yrs validity as what i read in here.

2)if ever my husband is with another woman already or they are staying together what legal actions should I take then?

3)If Im there already and have that IR1 visa as opposed to CR1 visa could I file for a divorce without having any problems with my immigration status even if were not able to stay together that long period of time?

I do still love my husband ,I just want to know the whole truth and see it with myself even if it pains me for whatever I discover when I get there but im prepared.Please I need your opinion guys and need some of your advice..

Wow that really sucks and I'm sorry. It's guys like that give the rest a bad name. It is also stories like this that my wife hears about and why she acts crazy sometimes. As long as you have your visa and can pay your own ticket there, you can go. I dont know that i would go confront him. As far as getting the greencard, it would probably go to his mailing address and i dont know that he would give it to you. You really need to be able to talk to a lawyer on this. I honestly dont have a good answer for you and what you should do. I do know that if you do get your 10 year greencard, and you do get a divorce, you cant become a citizen until you have been in the US for 5 years.

There will be more people that will have a better answer or personal experience with this and be able to better advise you. Sorry again, be strong and i wish you the best.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

I'm sorry to hear that..I hate the process just keep people apart from each other. Whatever you do, be strong, think it hard and careful what a good decision for you. You might have to discuss with him about this or go to the lawyer. If he really loves you or wanna work this out with you, he will find his guilt or realize that he screwed everything and I hope he will come back to you. I hope things between you guys work this out together.

1. As long as you are still married (you have not been notified the divorce is final) then yes, you may enter the USA and receive IR1 status. Bear in mind, however that the green card and social security card come in the mail, so if you aren't sure you'll be able to receive them at your husband's current address, notify the officer you have a new address. You can use the address of a friend or relative for this purpose and send in another change after you are established.

2. Other than possibly filing for divorce, I'm not aware of any needed reaction.

3. Yes, if you enter the USA and receive the endorsement of the visa followed by the green card in the mail, you are free to divorce. Unless your husband claims you defrauded him and convinces USCIS that's true, whether you remain in the USA is up to you.

Couples say lots of things to each other. Unless a divorce is declared final, you are married.

I am going to play devils advocate here, why would you want to go to the United States if your husband is not supportive of you doing so? If you do go, where will you live, where will you work? Jobs are hard to come by, especially jobs paying enough to support a place to live. The economy in the US is terrible, there are many people who have lost their jobs and are out of work. If he does have tax problems, you being married to him also have tax problems. In other words, if you do find a job you run the risk of the IRS garnishing your wages also. Isn't the reason you wanted a visa, so you can be with the man you love? I do not see any benefit for you to leave your country, family and friends if you and husband are not together. If you two can work things out, then all well and good, but until then I would not even consider going to the US. Jeff

I am going to play devils advocate here, why would you want to go to the United States if your husband is not supportive of you doing so? If you do go, where will you live, where will you work? Jobs are hard to come by, especially jobs paying enough to support a place to live. The economy in the US is terrible, there are many people who have lost their jobs and are out of work. If he does have tax problems, you being married to him also have tax problems. In other words, if you do find a job you run the risk of the IRS garnishing your wages also. Very good question, Jeff. For the LIFE of me, I cannot understand why a beneficiary would want to come/stay in the US after the relationship with the petitioner has failed. A beneficiary is being petitioned to the US for one reason and one reason only: To be in a loving relationship with her special someone. Period. US is no longer the land of milk and honey. More like the land of gang bangers and hobos! Peace.

PS, K1 visa prevents sad scenarios like this one. My condolences.

This question is really none of our business and off-topic for this forum. If for no other reason than to secure a legal divorce in the USA instead of needing to go through an annulment process in the Philippines, that's enough.

No problem if you don't care about being recognized as being single again in PI. You could file in the US then.

As I understand it the Permanent Residency is conditional for 2 years and then after 2 years you have to still be in a relationship and file paperwork for the Green Card to stay in effect. In this case if the petitioner is not supportive of you coming to the US you will lose your legal status.

Thank you to all who shared their ideas,opinions and concerns on my situation I greatly appreciate it.To Jeff,yes thats my main reason why I want to go there bec. i loved him.When I went to my interview last Nov. 12 in my mind all I want is to be there with him for what hes been through as his wife its been almost 2 years we haven't been together and now that i have this golden ticket for me to be there with him He just told me another reason that he had an affair before and now the girl is pregnant.

I dont consider it Hopp as failure relationship right now,Im not after for what kind of life he have to offer when I get there even if we have to start from scratch I am willing all I want to happen is to have a family with him.Im married with him already when this income tax problem occured so either were staying together or not right now im really part of it.I dont truly believed in divorce,if theres that small chance that I could grab I will just to save my marriage w/ him.

Not really true - the OP will enter after their 2nd wedding anniversary and will get 10-yr card. No removal of conditions for her.

You understand incorrectly. If she enters the USA for the first time using the CR1 visa after the two-year wedding anniversary, the card is good for ten years. She'll have IR1 status upon entry.

IS it ok that once I have my IR1 visa upon entry to the united states that I wont be able to go directly at my husbands place,like staying for a while with a friend?and how would I able to change the address where I want to deliver my GC and SSN.Or would it be a problem if I wont be able to stay with him directly ?

When you get to the POE make sure you give them a new address where to send the GC - confirm before leaving that they have entered it and that you are in the SAVE system.

Good luck! You can live with anyone you want, even if it doesn't work out with your husband. Owing six years of back taxes is not a small thing, nor is being father to another woman's baby. He is basically a liar. I would have to say he is not worth pursuing but that's just my advice.
