Hubby have not filed his taxes for 2005 and 2006, he will file them on Monday, Do we need to wait until everything has been filed or just have a copy of the form or like a receipt in his AOS package?

I have a question about this too. My fiancee didnt have to file taxes for 2006 and 2007 because he was a student with no income. Does he need to do it anyway? What are we supposed to do otherwise since they want to see three years of filed taxes?

My wife sent only the tax return of 2008 to the NVC. This was enough for them.

05/14/2009 - submitted I-130 to Chicago Lockbox

05/18/2009 - NOA1

08/21/2009 - NOA2 (95 days from NOA1)

09/01/2009 - NVC assigned case no. (11 days from NOA2 incl. 2 weekends)

09/15/2009 - got DS 3032 form from NVC by email

09/17/2009 - sent DS 3032 to NVC by email and by regular mail

09/17/2009 - received and paid AOS fee bill (paid online)

09/18/2009 - NVC accepted DS 3032

09/22/2009 - received and paid IV fee bill (paid online)

09/22/2009 - AOS fee entered into the NVC system

09/22/2009 - received AOS package

09/24/2009 - IV fee entered into the NVC system

09/24/2009 - received IV package

10/02/2009 - sent DS 230 package from Germany to NVC by UPS

A copy of the 1040 and all slips used on the return is sufficient.

It would be best if he filed the taxes. The instructions say that if you were not required to file to include a letter to that effect along with the IRS publication stating that rule but it would just be easier to file the taxes.

Hello,

My wife sent only the tax return of 2008 to the NVC. This was enough for them.

Yes, the instructions state that you only need to send the last year of returns. You would only send 3 years of returns if you think it would help to prove income in some way.

That said, you do have to file all 3 years, even though you are only sending one and I would recommend that you take the other 2 with you to the interview.

If a person made little to no money in a year they may not be required to file a return, in which case you would attach a note to the I-864 stating that - the 1040 instructions for each year state what the cut off amount is, you can google them, have a look and see what the cut off was.

Thank you for your answers. I will tell him to file the taxes if it is no big deal. Otherwise we will go with the ones from 2008/2009.

Another question, I was in US for a J1 visa and received kinda like salary but technically allowance and I was paying taxes and filed 2007 and 2008 taxes. Do I need to have my tax papers on the day of the interview?
