don't apply for ITIN, I made a mistake for apply ITIN.

first they denial ITIN, then they wsitch my status to marriage but what I lost:

student loan interest deduction

$300 stimulus

can't claim my wife as dependend.

total lost $1500 by that mistake, if I file single I can get $1500 more than what I get in tax return.

You can file an amended (up to 3 years after) tax return when she gets her SSN. I was also denied an ITIN but I'm submitting a amended tax return with his official SSN for last year's return.

Don't think of it as a mistake ...they would have found it and possibly penalize you if you filed single and were married...If anything, you can also file married filing separate (which I had originally done...)

so we don't need any documentation like the w-2 form? and, can we file w-7 now and have an ITIN before we file our returns?

Also, i didn't know about this when i filed my tax return for 2008. i just filed a single. do i file some sort of amendment or adjustment?

If you were married in 2008, you'd file an amended tax return. When you do, you'll file for a w-7 at the same time and attach it together to send in.

Linda, i'm filing an amended return. i heard that i have to submit a signed statement (along with the tax return form) asking that my wife be treated as a resident for tax purposes. is this true?

When I submitted mine, all I sent in was the w-7 with the requested documents which is the passport and identifying foreign documents along with the 1040x. Both were signed by my husband. Nothing else other than that.

I would just make sure to read the documents very carefully as our situations may be slightly different. I had to submit it twice because I had originally only sent in his driver's license from Vietnam and I needed to have his passport (which is a standalone document).
