Hi everyone,

im a newbie here but just in case i posted in the wrong forum just tell me and move it to the right one.

my question is simple (because i didnt really find the answer before): my fiancee is a us citizen and she is filling the affidavit of support I-134 and her dad is our co-sponsor.

the problem is that we dont know which form he has to fill.

i dont really want to call the embassy and pay the 15€ of fee just for a question but i would like your answer to be 200% sure. we dont really want to get our petition denied or delayed.

we know that she has to fill I-134 but she is not living with her dad, does he have to fill the same one or the I-864????

PS: im french, does US embassy in france accept co-sponsor?

Unless France permits, the general rule is that I-134 is not a co-sponsor document. Your SO should use I-864.

are you sure because the us embassy in paris corrected the instructions with a pen saying I-134 instead of I-864.

thats why if there is anyone who went through this in france it could be awesome to help or if anyone knows how it works in us embassy in paris.

I'm a bit confused. It sounds like you're still in the K-1 process (your status here shows AOS approved?!?). Your fiancee and her dad should each fill out the I-134 form with supporting documentation. There is no need to notarize I-134. Just make sure if they declared assets in the form, they must provide evidence. Clear?

If you are not married yet and you are about to apply for a K-1 visa then yes state "K-1 visa". Yes. Again there should be I-134 from her with supporting docs and I-134 from the dad with supporting docs. I-864 will be required later on after you're married and are filing for AOS.

Yeah it is confusing and that's why I didn't let my French fiance do it alone. US Immigration process is too foreign to him.

A K visa petition utilizes the I-134. As stated before, when you marry and adjust status for the foreign spouse the I-864 will be used.

There are no provisions in the I-134 for co or joint sponsorship. Each form stands on its own. That may be where the earlier poster was coming from. However, when K visa petitioners utilize a co/joint/substitute sponsor it is with form I-134.

how long does it take (around) for the us embassy in france to check everything and then send the packet 4? is it long or not?

There are recent interviews for members here on VJ. Take a look at our timelines and you will get a sense of how long it takes between Packet 3 and 4. It's 1 month on an average.
