Switching K3 to CR-1

Hi all, i have my I-130 and I-129f in processing, have only received both NOA1. I am now thinking of abandoning the K3 and go for the CR-1 which i imagine is far much better than the K3 visa. How do i go about it? what are the procedures and how long can it take up to?

Can i also apply for both the k3 and CR-1 and go for whichever is being granted first? What are your thoughts guys? I am thinking that the immigration are not worth dealing with so i want to be done with them here and nevermore when i am being admitted to the states.

Thanks.

You simply ignore all future correspondence related to the I-129F and its case number and press forward with your CR1 process. Yes, it's really that simple.

Ok, I guess i will just wait for the I-130 approval and then follow the next procedures right? or am i suppose to begin somewhere now? Thanks for responding.

Your I-129F and I-130 will likely be approved on the same day. There is nothing to do until your petition is approved at USCIS. Then you will ignore all correspondences regarding the K-3 at that point if you choose to follow the Cr-1

Good luck.

This seems interesting, i hope they get approved same day and then i will have more reasons why to switch to Cr-1. Is there any guarantee that my Cr-1 visa will be approved if my wife is present on the day of interview.

Below is my time, can anyone project when my I-130 can be approved?

Sorry, no we cannot tell you when your petitions will be approved because we have no idea the volume of petitions at USCIS. However, your timeline suggests around March-April based on other VJ timelines.

No, no guarentee that your visa will be issued. And your wife MUST attend the interview, it's not an 'if' scenario.

Good luck.

If visas were guaranteed, we would just register our spouses and bring them home instead of petitioning, applying and interviewing.

Check out "Ling Che's NVC shortcuts" and get everything ready to submit.

I have read "Ling Che's NVC shortcuts" and have been using most of them. I was wondering if anyone recently has been succesful doing this; or has experience with this part:

we have an interview sceduled for the K3 on Dec 11 at the Embassy in Manila

the I130 is still being processed at NVC

I would like to keep the interview date of the K3 but change it to the CR1 if it is ready at that tme

is the NVC receptive to this?

the shorcut says to speak to a supervisor at NVC, the operator cannot do this? Is it difficult to get a supervisor?

do I keep calling to find out when they are ready to send the petition to the embassy and attempt this at that time?

what if i miss that exact time and they send the I130 and schedule an interview for a later date than the K3 interview?

thanks for input.

Russell

K3 was originally designed [LIFE ACT] to shorten the time families are apart. People could apply for both K3 amd CR-1/IR-1 and take the K3 interview first, get the visa and go to the US and when the CR-1/IR-1 interview came up go back and take the CR-1/IR-1 interview and get the immigrant visa and the GC without having to do AOS.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

Thanks, my questions are:

1. how do you know when the CR 1 package is approved by NVC; and so when to call and discuss with the Supervisor.

2. what exactly do you ask the Supervisor? should I ask them to reset the existing K3 interview to a CR1 interview? and also to expedite the CR1 package to the embassy.

3. the shortcut page said this works with some Embassys; does anyone know if this works with the Embassy in Manila?

thanks again,

Russell

Once the processing at the NVC is completed, you can call to see when the package is approved and an interview date is set. To change a K3 to a CR1 interview, the CR1 package must arrive to the embassy prior to the interview date.

Hope this helps!

Best of luck!
