Proving Domicile if we don't live in America

Timeline

My wife and I live in Ireland, not America. She is an American Citizen, I am Irish.

We have all the documents submitted and we were waiting for our interview date when wouldn't you know they hit us with a request to prove Domicile for the sponsor...

Now, below is a list of things we sent proving Domicile - any ideas?

Letter from Landlord advising rental agreement in a property

Letter from Pastor of a Church we had attended while there

Three letters from employers, advising that my wife can have a job with them upon her return

What are they looking for?

- Moving quotes for our belongings?

- Bank details of our American account?

Any help would be much appreciated, thank you in advance.

ps - I take it when they say sponsor, they mean my wife, and not myself?! Thanks

Hey,

we did DCF in Ireland too, last year (my husband is the USC/ sponsor). We gave a US mailing address - his sister's house, a US bank account in his name, and the sale papers to our newly bought home (which was also part of the I-864 as I got the visa based on assets, not income).

PS" you may get more replies by posting this in the DCF forum, as it is a specific issue dealing with DCFers (ie couples that both live abroad).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes they mean the USC when they say the sponsor needs to prove domicile. I'm doing DCF and I sent a copy of a bank statement from a US bank that I have used since I was 17, an explanation that I have always used my parents mailing address as my permanent address during the time I've lived abroad, a letter from my parents stating that we will be staying with them upon our return and a copy of my GRE test results showing intent to apply for Grad Schools in the US. They basically need an address to be able to mail the greencard to. Including moving quotes, etc. would be good to add as well.

Thanks guys.

First of all, when we started this application process my wife was in America, so we have been through the NVC, not Dublin for this one.

They have an address where her parents live, as well as a letter from them saying we can stay there....do you think the bank account is needed, as apart from supplying that we have nothing more to offer as proof.

Bank account is good proof. Does she have a valid US drivers license and/ or voter registration? That is good too.

then get a rental agreement or lease agreement on that us address

then have utility bills on that us address.

Partial throttle:

bank statements to a us address

tax records to a us address

IDEAL:

lease in both names to a us address.

They have also asked that we resubmit the I-864 form again, do i really have to do this, even if we're just sending domicile proof?

Yes, if they asked for it, you must give it to them. They may just want it in case there is any updates to your assets etc, especially if it has been a while since you sent in the first form. Though... what address did you put on the I-864 form? We put the US mailing address (my USC husband's sister's house), maybe that is what they want to see on the re-submitted form?

Well we live in Ireland, so I gave our address as the Irish one, do I need to fill out the form with the American adress, so they can send the Green card? ANy help would be much appreciated. I don't want to fill out the american address and then they come back and say there is a mismatch?!

Well, we figured as the I-864 is only handed in at interview, it would be better to put the US address for mailing, as well as to show our intent to live there. I know a lot of DCFers do it this way, but not sure it is required. Could be they just ask for another form because they lost the last one...

A letter is not a rental agreement. Sorry.

Actually, it can be. If an agreed price is made, and stated in said letter, it is enforceable.

The letter is signed by the owner of the property (my father in law) outlining the amount we would have to pay each month...i thought that would suffice....

I'm still not sure which address to put on the I-864, when it asks 'Residence address' technically it's in Ireland, but do I put the American address? It has a seperate one for mailing, for which I could put the irish address?

We're still not out of the NVC, so it's not a DCF. We began the NVC before my wife moved over here to live (10 months ago)

I am living in Canada, and I am the USC. I put my Canadian address as it would technically be lying if I put my US address that we will be living at.

Ya, but it's really not.

A Signed Rental Agreement is 'in effect' , 'in force', with a prior start date (hopefully earlier than the interview date ) and the 'letter from parents' is a 'forward looking thing' , something to engage (with little formality ) after interview date. As I've described it, perhaps you can understand that it's NOT the same thing, even though the 'desire' to have it 'work similar' is there.

Forms are easy - to the OP - can get FORMS anywhere... Think about FORMS, ya ?

I-864 address on USC - I suggest to use the address that the USC used on any tax filing paperwork, for prior years.
