I second... not much sympathy. It has taken some of our member s YEARS to get their significant others here.

mis-information. There is 100% a way for them to adjust their status. just because they came illegally, DOES NOT mean they cannot become legal. The US Citizen needs to Petition on their behalf an I-130 and then apply for the waiver. I can give out names of HUNDREDS of illegals that are now legal. It's a long expensive process, but that is so horrible for you to say there is "NO WAY, so back home he/she goes" you are obviously mis-informed.

How can they adjust their status when there's no status to adjust from? Entering illegally--entry without inspection--is different than overstaying their visa. Which one can adjust status from since they had a visa at some point of time.

The only way to do this is to leave the U.S., file for a IR1, have it denied at the interview and then file a waiver. And then hope for it to be approved.

This is my limited understanding. Maybe someone else can chime in.

The last time it was allowed to adjust without leaving was the LIFE Act signed into law on Dec 21, 2000. It had a very narrow window of opportunity allowing certain people who had entered without inspection to adjust status. That window has long since closed and there has not been another opportunity since then. HUNDREDS of illegals are now legal as a result, but it no longer applies. Currently there is no path to legal status without first leaving the U.S.

Your post can properly be categorized as the greatest misinformation in this thread.
