Hi Visa Journey,

I'm a newbie here. I have a question not really relate to sponsoring somebody but this is the ugly picture after the the process is already completed.

My uncle, let's call him C. He sponsored his sister and her 3 children (16,21,24 years old). They came to the US for about a month now and the 21 & 24 year old want to move out and get an apartment or something and want C to fully support them paying rent, expenses, school, 100% of everything, a whole package. C refused, and they say they will sue him and would tell on him that he kicked them out, and that he is supposed to support them for 5 years.

Can someone please answer me if this is something possible. My common sense says that this is ridiculous and they can't sue. Please let me know what is the terms the person sponsoring has to do when the family member is here...or direct me somewhere that I can know more about this. Oh, and can we send them back home? heheh or this is already a done deal?

Sue him in what court? Your uncle filled out financial sponsorship papers, which state that he can be held liable only by the government (if the government so choses) if the sponsored immigrants benefit from means tested benefits (unemployment, food stamps, etc.). That's it. The US government can chose to sue the sponsor, but the immigrants have no pot to piss in. Your nephews are more than adults. They need to grow up....get jobs and support themselves. They are not your uncle's responsibility.

Sponsorship is to prevent the beneficiaries from becoming a public charge. This means if they benefit from any public services that are usually reserved for USCs (food stamps, medicare, etc.) the sponsor can be sued by the US Government.

I'd say go ahead and let them sue him. They'd need to find a lawyer who thinks they'd win, afford to pay him a retainer and actually succeed in court.

What is their GC status?

Welcome to America, where anybody can sue everybody!

Your uncle "C" (I would call him "D") has pledged to the United States Government that his lovely nephews and nieces will not be a financial burden to We the People. He did not sign on the dotted line promising a certain lifestyle which, in any case, would not exceed that of a social security recipient. If there was any government agency where one could go and ask for cash or an apartment, we would not have tens of thousands of American citizens, many of them decorated veterans, sleeping in cardboard boxes.

By providing all of them a roof over their head and feeding them, he's doing plenty. If the ungrateful young 'ones choose to move out and rent a place on their own, they are free to do so; on the same token, they are old enough to get a job and provide for themselves.

Let them retain an attorney (no sane one will take this without cash in hand first) and sue the good uncle. There's no way for them to get a judgment requiring the uncle to support them financially.

For all others, this is a good lesson on why you don't want to co-sign a student loan, and why you don't want to sign any affidavits of support for people who are not your own parents or children, ever.

For all others, this is a good lesson on why you don't want to co-sign a student loan, and why you don't want to sign any affidavits of support for people who are not your own parents or children, ever.

I think that's a big of an exaggeration, in fairness to anyone who needs a co-sponsor for immigration. We will be using a co-sponsor (my SO's mom) and you can bet that I would leave the country before putting her in a situation that put her at risk of being sued by the US Government. Agreed on the student loan, though. The two are very different kettles of fish.

as soon as the boys get their GreenCards - they boys can go into the Army for a 2 year enrollment. Let them learn what it means to be a Soldier in the US Army.

The Army will take care of them, for two years.

I think that Minya's wife summed this up very well but I just wanted to point out that unemployment is not a means tested benefit. Uncle "C" would not be held responsible to repay the gov't if any of his sponsored relatives collected unemployment.

They can't be sent anywhere. They have valid Green Cards.

Uncle C should read the I-864 he completed to see his responsibilities. As others have stated, they aren't entitled to him feeding, clothing, and housing them.

Urge them to find an attorney that will fight their battle. That should give them a nice reality check.

It is much moe complicated than has been stated above.

Read the form.

I have heard of a spouse using it to claim support, it would be an interesting case.

But a warning to others.

It would costs a lot to take it to court, whether a lawyer would be interested is another issue.

Your uncle is doing more than sponsoring them, they live in his house. He is only responsible for them if they become dependent on govt. aide. Other then that they should be helping around the house to earn their keep or have a job to help with a rent or mortgage. Did they think they would come to America and it was just a free ride on your uncle? Tell these brats to get a job!

They sound very selfish and ungrateful that their uncle had to jump through hoops just to get them in America. I feel for your Uncle, he was kind enough to get his family to be with him and then his family takes a dump on him.

I don't think it's an exaggeration at all. It's good advice. I don't think I would be going through the process at all if I had to ask someone else to help sponsor my spouse. It is alot to ask of another person. IMO But people do it all of the time.

I say let them sue. They actually don't need a lawyer to bring a lawsuit, whether in small claims court or higher. But, I'd like to meet the judge who would empathize with two young men who instead of working hard are wanting to used the uncle and be bums.........I don't think that judge exists. And lawyers won't bother with this kind of thing unless they are getting !!!PAID!!! If they had the money to pay for a lawyer, then they could use that money to pay the rent. They won't get anywhere with this.

My bet is it's an empty threat.

Poor kids will soon find out that not only that lawsuit won't work, but also, US government WILL NOT provide them with means tested benefits. LPRs are not eligible during first 5 years. Without uncle C. they are left to their own devices. It's not his job to take care of them. ONLY if US government provides them with means tested benefits (for which they have to stick out somehow for 5 whole years!), your uncle COULD be sued to re-pay that money back to the government.

It is correct that there were some lawsuits obliging a sponsor to provide support per I864 directly, sponsor to LPR. But, that was for a divorced spouse, which is surely different.
