Approved but sent back to USCIS for review????

Timeline

I was sent to this site by some close friends who successfully married with a fiance visa....

My fiance is in Ukraine, we filed 129 petition for fiance visa back on May 1st.

October 9th, 2009 - Petition Approved and sent to NVC (Department of State National Visa Center)

October 26th - on the website, sent back and received by USCIS per request by the State Department for review.

Can anyone give a little advice as to what this might be all about? Also, what is the time frame for a review if you have ever heard of this happening.

In my reading on the past threads from this site, it looks like there were reviews if something was wrong with the petition or the interview process, but I have not received any letters or notices stating why there a review was called for.

Any help would give my fiance and I some very great peace of mind.

05-21-2009 filed I-129F (check was not cashed for quite some time)

08-21-2009 contacted Senator's Office

09-01-2009 Petition received, NOA1 sent (finally)

10-09-2009 Petition approved, NOA2 sent

10-16-2009 NVC received

10-26-2009 NVC sent back to USCIS((( their reason: a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you

No RFE has been sent or received, no updates given, all trails end with recording or operator/officer who says must wait 180 days

1-26-2010 this will be the 90 day mark of the "review", I was told I can call back and issue a formal complaint if the case has not been touched by this date.

Still, we keep hope alive - I love her so much for staying strong.

That happend to my file. Basically the person who approved it did not check it properly. In my case a box was left unticked and uscis should have issued me an RFE. Unfortuneatley you wont know until you get a letter from uscis. our petition was returned on august 25 and we only got the letter on sept 10th saying that NVC sent it back for review, then it took another month before we knew about the RFE. I only just received the reapproval in November.

You should keep on top of this Dacko - it may be beneficial for you to contact your congressman .... unless you dont mind waiting the extra time as Kimbear has.

You should keep on top of this Dacko - it may be beneficial for you to contact your congressman .... unless you dont mind waiting the extra time as Kimbear has.

Thanks Malarie - I just might do that. I already have a contact at a NY senator's office and they helped us get the first NOA, which was great.

I might just have to send in a fax once again with this latest issue.

Nope just a box unticked, they sent us the same paper as what was missing on the petition. Never trust a lawyer to proofread the papers before sending it in.

LOL trust me i did not wait. I had a lawyer, a congressman and my fiance and me calling like mad. Unforunteately they cannot do much. Alot of the waiting was due to the crappy us postal service which is bloody slow, and the time it takes for them to log packages in and get them to agents.

That said...NVC has determined that they believe something in your petition is not correct. This happens sometimes, even the consulates can do it. USCIS will review the petition and either re-affirm it and send it back to NVC or notify you that something needs to be added/changed, etc.

You will not receive a notice for this, they (NVC) are not asking you for anything, USCIS will do that if needed. I do not know how long this will delay the matter

You are spot on with the finer women in life thought ))))

I just hope it is nothing and the matter is resolved quickly...God only knows how happy I am with my family...and the sooner we can be together, the better life will be. I am sure of it.
