Hi all,

this is my first post. I have been through this site a couple of times. I think I can get some realistic help here. I am yet to be married/engaged to my girlfriend, and am being pro-active in getting everything right first time.

A bit background about myself :I am a US citizen filing for an Indian (fiance/wife/girlfriend ;) ) national. Having said that, I have grown up in India and both me and my girlfriend have known each other since like 1st grade. By that i mean my family and hers is in India. In the US i am alone. Now with regards to her coming over to US, there are 3 routes that I know of. Pls correct me if I am wrong

1. Applying and getting K1 and marrying in the US

2. Marrying in India(preferable) and going for K3

3. Marrying in India and waiting till I-130 petition is approved.

The problem I have is I am unable to decide which route to go by. And time is a major constraint.

Getting married in US is logistically very hard as I am yet to become financially secure and getting the folks here for just the wedding et all. it seems like a big mountain. If i go K3 route then according to the processing times K1 is faster, seemingly. With a difference of 3-4 months?

Also I have read that K3 approval and I-130 processing takes about the equal time give and take a month or two. As this whole activity governs next 5 yrs of both our lives I do not want to mess up :unsure:

My other problem is having no contacts, i am in 2 minds about using an attorneys help. As in some posts here has been justified you dont need one if you have all bases covered.

Please let me know your thoughts on my case.

Note - you have 90 days to marry once your girlfriend/fiance enteres the US (which makes travel plans for future in-laws difficult)

Check the timelines for how long it takes in each case and decide for yourself. If k-1 is the best route then you have to get legally married here in US within 90 days of her coming here.

Hi

I am not sure you would remember but you had advised me over the K3-IR1 question. You can always look up the page on visa-journey.Thanks a lot for your advice :)I had actually posted my question regarding immigration processes to have some prior knowledge so I dont stay in dark when it actually is time!

To begin with I had been recently to Mumbai and have gotten married to my wife :P So we r all ready to start our process. I have her signed g325a and all necessary documents in place. however I had some questions as usual:

1. All of my wifes documents are in her maiden name(passport, birth cert, ). She has taken my name as such. Would this hinder in anyway the process? We have 2 forms filled in her name 1 in maiden and 1 in her new name. M not sure which should I submit

2. We have prepared 2 affidavits as mentioned in the I-130 instructions from either of our friends who know us individually and together very well. Does it make a stronger point having an affidavit made by a person knowing about us residing in US?

At this point prior to filing these are the only questions in my mind.

I would greatly appreciate if you could answer :)

Congrats on the marriage

No, the documents in the miaden name shouldn't hinder you, they didn't for me. The visa will be issued in the name in the passport and the green card in the name on the visa. If you intend on changing names, do it before the interview to avoid costly name changes in the US

No, affidavits are simply the word of someone, most people don't include them preferring to focus on primary evidence

thanks..for that.. yeah the name question just popped in my head as a flag.

From what we read as filing instructions in the i-130, we made the affidavits..Do they need financial co-ownership or common residence as a proof? We havent really lived together prior to marriage or after. Coz I was there for just a week, later after the marriage, I had to fly back here..

Also the wedding pictures proof is needed during her actual interview..i am not submitting them with the i-130 now..is this correct??

Suggest you submit photos with the I-130.

There's a list of stuff, in the I-130, for 'bonafide marriage evidence'.

Sure, it seems difficult or hard to do, as yer just married, and living in different countries.
