USCIS, NVC and STATE DEPARTMENT...

Timeline

When the CO tell you that they are sending your case to the State Department because they need a decision from a federal lawyer.

What does that means?

The "CO" also told me that Dept. of State would give an answer in 2 weeks maximum, but 2 weeks is over already. Also, I send an email to the embassy, and they told me that can take a lot more than just 2 weeks.

Again, what does that means?

Anybody here in the same situation?

09/22/2006 - I-129F sent

02/14/2007 - Interview in Rio de Janeiro - VISA APROVED!

03/03/2007 - Flight out to States

12/21/2007 - Wedding!

AOS timeline

02/27/2008 - l-485 sent

04/29/2008 - AOS Biometric

05/01/2008 - I-94 Expired

07/22/2008 - AOS denied

10/28/2008 - In removal proceeding

01/14/2009 - Flew back to Brazil ;(

02/10/2009 - Hubby flew to Brazil ;)

IR1 timeline

09/23/2008 - I-130 sent

11/06/2009 - Interview in Rio de Janeiro - CO need an Advisory Opinion (sent an email to DHS with my I-94 and court order)

12/02/2010 - Hubby went back to the U.S.A ;(

Timeline

The embassies/consulates are under the direction of the Department of State.

USCIS is under the direction of the Department of Homeland Security.

Two different entities completely.

In general, it means exactly what it says. A decision about what? I assume you at least have a clue.

Facts are cheap...knowing how to use them is precious...

In general, it means exactly what it says. A decision about what? I assume you at least have a clue.

Well, that is the point... The CO didnt give me any clue. He was looking very lost. He told me that he didn't know what to do. He was looking on the computer, the another CO (boss) was looking on the laws book and the another lady was talking to me. All three people told me they had no clue to deny or approve my visa. But, if I have to give you any clue I am going by the my I-94 and the court order, I think they are checking to see if is a fake one. But, I don't know! Because the I-94 was a mistake, made by the CBP and the court order was toooooo nice - the judge wrote very nice things about my case.

Perhaps you're expecting all readers to know about this court order and I-94 but there's a good chance many others only know what you wrote in this thread. Anyway, you've got more than a clue. They want a State Department lawyer's opinion before making a decision. At this point, you wait for that opinion.
