I’ve looked all over VJ for this information in vain.

My son is here in the US on a F-1 student visa. He is 20 yrs old and he’ll be turning 21 on Dec. 4th 2009

I, a USC petitioned for him on Nov 9th 2009 using I-130, and at the same time he filled I-485 for AOS. He sent in the EAD too, but one week after sending the I-130. We have received the NOA1 for both I-130 and I-485 and checks cashed.

Now, my question is this; when he turns 21 on December 4th 2009, will this case still fall under “child under 21” which takes a shorter time compared to the “unmarried over 21”?

If the case is going to be handled as “unmarried over 21” then what happens?

Thanks!
