Filing for Citizenship

Hi Guys, a friend of mine was married to the USC and they got divorced before he got his 10 years green card, he did file in his own good faith, and he got approved without interview, so now he will file for citizen in February of 2010, he was wondering if they will mention his divorce at the interview or something, i told him you dont have to worry about, thanks guys peace.

I hope he knows that if he is no longer married to the US citizen through which he emigrated, he'll have to wait until he has been a permanent resident for 5 years to apply (instead of 3) for citizenship.

Thanks guys for your respond i do appreciate it, i told him the same too he is little confused if it will affect his N-400? i think he doesnt have to worry about it because the immigration already knows that he is divorced and he filed on his own!! thanks.

If he has been a permanent resident for 3 years only and he is divorced, he is not eligible to file for citizenship yet. His divorce isn't going to hurt him with immigration, but it will mean that he doesn't qualify for the 3 year category. He needs to wait until 90 days before the 5th anniversary of his green card before he is eligible to file for citizenship. There is a question on the form that asks marital status - he just needs to fill in divorced. It won't have an impact on his citizenship unless some problem turns up between now and when he files that makes them question the legitimacy of his marriage and arrival to the US in the first place. That is always a possibility but not a big one as he has already removed his conditions on his green card on his own.

Thanks Kathryn for your answers, yeah he got divorced when he was conditional green card, and he did filed in his own for 10 years green card and he got approved without interview becuase he had a lot of proofs with his ex wife jointly like mortgage ...ect, so now he is going going to file for Citizen in February of 2010m and he has been here 5 years and he has right to file as for it, he was just little curious if they are gunna ask him why he got divorced or something like that, i told him its no big deal and they already knew that you are divorced when you filed for removing of conditions, thanks .

5 years after you get 10 yrs green card, 3 years after you get your green card if you are still married, 5 years after you get a divorce even u had a conditional GC, and yes its a big deal when you apply, they will keep dragging you up to 5 years, its hard very hard when u get a divorce and try to apply for citizenship, and yes they will ask you about your marriage of course. so you are going to have that green card untill its almost expired before you get your citizenship. or may be not in some cases unless you hire a good lawyer. ta dik sa3a b9a hta tched lhram l9asis a sahbi malek zerban a ba l3alawi?

Thnaks for your reply, i know all that stuff and i had told him they are gunna review everything even if you are married or not!! how come you speak Moroccan and you are from Turkey!!!
