I'm the American petitioner. I have to fill out the I-134. I'm currently in law school. I'm not working. Any other students here? How is the student status going to effect things?

I can get up to $19,000 in student loans for living expenses. What dosucments do you think I need to send in along with the I-134.

Looks like you need a sponsor. Do a search but I think I read that you'll need a sponsor.

whatever you send, be sure to use a spell checker on it.

You'll need an I-134 stating zero income, so no need for supporting documents. What you need is a qualified cosponsor. Then based on their financial situation, provide appropriate supporting documents.

What's a "dosucment"? Is that a Hunan delicacy of some kind? Perhaps some kind of fresh water shellfish?

USCIS said the only forms needed for the I-134 is proof of job and income, and bank statements. They said tax info is needed for the I-864. Anyone have experience with this?

Yes. You're going through Guangzhou, a Consulate, part of the Dept. of State. Ignore what USCIS tells you particularly when it comes from the misinformation line. Ask your questions here. Your cosponsor should provide at least one complete tax return and recent pay stubs. Three tax returns is best practice for Guangzhou. When you adjust status using the I-864 is when you pay attention to USCIS instructions. The I-864 instructions are excellent.

Well, thanks for the comments so far, though they're a bit discouraging. I can probably get my dad to co-sponsor but I'd really rather not.

Will they look at "the whole picture?" I lived in China for a while and there shouldn't be any problem establishing a bona fide relationship. My fiancee's English is excellent and she currently works as a transaltor. Will the fact that I have an advanced degree and am attending a top 25 law school matter? That she's also a university graduate with good work experience, including for international companies? Are they really concerned she's going to become a public charge?? It seems stupid, but I guess this is the government after all...

None of that will matter for their judgment on the public charge concern unless you have a qualified sponsor. They take that responsibility quite seriously. This is not about what you are comfortable with or would rather do. The proces is NOT comfortable. You bend over and comply with the requirements of the process.

your period of residence in china, fluency in chinese (if you have it), your finacee's fluency in english, and proof of a relationship during your residence in china are very important evidence you should document in your application. use notraised copies of your passport with chinese visas, copies of travel documentation, hotel receipts, photos of the two of you together, certificates of language course completion, her CET certification etc as documentation. this kind of stuff is a sure win in regard to the legitimacy of the relationship.

you should provide a short coverletter with timeline of relationship highlighting the time you spent in china and knew your fiancee (assuming they overlap). you should mention in this cover coursework and qualifications either of you have completed or hold in the other's native language. she should remark on her CET 6 or 8 qualification and translation experience.

your advanced degree and current enrollment holds no weight. her degree and work experience with foreign companies does. your income history is a qualifier that is hard and fast. student loans are not income and do not count toward this qualification. you either need to get a job or find a sponsor.

Thanks for the advice. I presume most of this stuff -- photos, copies of passport with visas, CET -- should be brought by her to the interview. How about the cover letter? My fiancee has already sent back the form saying we have all the documents they asked for in packet 3. Should she have sent some kind of cover letter with it, or should this also be brought to the interview?

On the forms, she wrote down the international company and American company she worked for with address and phone number. You think she needs some other kind of proof she worked there?

That 'cover letter' is an Evolution of Relationship letter, and should be written by the Petitioner. If yer still in the states, get it notarized, sent to her asap - she'll submit it on interview day DURING the interview.
