this may seem like a fairly novice question, but i'm having problems finding definitive answers.

my wife and i were married on 10/31/09. we have not yet begun the process for our CR-1/IR-1 as we have not received our certificate of marriage. obviously, we would like to see each other as much as we can while in the process. due to work constraints, i can't take as much time as i would like to visit her in canada. ultimately, my question is what are the exact restrictions/limitations against her visiting me in the US while her immigration paperwork is in process?

thank you in advance!

Canadians can visit for up to 6 months on the visa waiver program. Check out the visiting FAQ for tips on what sorts of "ties" she can try to prove.

One thing we found useful was the receipt notice for the visa petition - it shows that you are invested in immigrating legally and have started down that path.

The Canadian forum is full of people who have visited while in process - sometimes for great lengths of time. The trick is convincing the border guard that she's not going to try and stay.

Here's a link to the visiting while visa is processing FAQ:

There's an extra link at the bottom especially for our land neighbors! :)

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Oh. Well, I didn't go to the link just noticed it when I was referring you to that page. *sorry!* I don't think you need anything more than was on the first layer. Just thought there might be extra info at the second link.

CBP FAQ - Documents required by Canadian citizens

Once you're in that link you can do a search for more information.
