Keep busy and stay positive. (I know it's easier said than done.)

My fiance interviewed US Embassy London October 15, 2009 for K-1 visa (visa application suspended until receive passport and I-134 from co-sponsor)

Documents and passport sent to Embassy on Oct 19, 2009

We are still waiting for the visa also... 7 weeks now

12/4/09 Letter from Senator inquiry - Chief at Embassy said no originals of I-134 were sent : O

12/8/09 FedEx Original I-134 from co sponsor to Embassy

12/8/09 Phone interview to me from Embassy regarding my fiance

Congrats! Two months would be a nightmare. Any idea why so long (if not too personal)?

We just got out of AP after two months. I hope yours doesn't take as long.

05/04/09 -- K1 visa, NOA-1

09/18/09 -- K1, NOA-2

01/26/09 -- Interview passed in Moscow

03/02/10 -- POE, JFK airport

05/23/10 -- Wedding!

11/16/10 -- 2-year green card approved

04/01/13 -- 10-year green card approved

11/23/13 -- N-400 mailed

To be honest I have no idea. The only thing they asked for was more proof of our relationship. As to why it took so long I couldn't tell you it was par for the course if you ask me. We were also in AP with NVC as well. Oksanas mom already live in the U.S. so I am not sure why they looked at us so hard, but it's finally over and we can finally be together.

Jeff, sorry I just re-read your post can you explain to me the fact that tatiana has an annulment paper? I thought these were only given through the church and are not a legal document outside of the church, perhaps they were confused by this and you would have been better off submitting the legal divorce decree instead of the church annulment or a I wrong about the annulment?

It is a actual annulment. In Illinois they call it a "Certificate of Dissolution Invalidity of Marriage" I ordered it from the county clerks office in Illinois she had gotten married. I made sure it was a certified copy, with wet stamps and signatures. In other words, she got married, then the next day, they had it disolved. She calls it annulment, but honestly the actual document says Certificate of Dissolution Invalidity of Marriage. I think in Las Vegas it is called an annulment and in Texas too. I think it just depends on the state. It is like the super simple divorce, where in you were only married like a day or something very short. I also gave her the judges order and the final recorded filing of the order in the county clerks office in Illinios. I am sure there is some legal duration or something to qualify for a Annulment / Certificate of Dissolution Invalidity of Marriage, but I don't know the timelines as I am not a lawyer. hehe.

What frustrates me I provided all this information including the fact she had been here 4 years prior on a K1 visa already, leaving under good terms, no overstays and such when I filed the K1 with USCIS. So I guess they had not read the large case file? Eh, it is just strange that they were a bit shocked by seeing this document and then checking the database and seeing they have already issued a visa for her some years ago. It is not like we lied or sprung it on them, it was told up front, with evidence and such very early on in the process. /shrug.

So I hope I have helped provided a bit more information to those that are wondering. I had a suspicion to be honest the whole "been to usa once on K1 and annulment" could come back on us at the interview, but I had hopes it was researched and done at CIS. We had no RFE or anything during the CIS portion. Bah, well I can only wait and hope now. :)

I wish all those that got through, CONGRATS!!! I hope your sweeties arrive before the holidays. I hope Gary and Alla are right and maybe it will be shorter for me too. :)

I think there may be some overlap in terms. Dissolution is a legal term, also used in most states to differentiate between a divorce (severance of a legal marraige) and what is in essence the position that there never was a legal marriage at all. Some states call this process a dissolution, and I think (and have read) others call the process annulment. As stated above, annulment is also a term used by churches to define the same situation.
