First i want to thank all of you who tried to help me and I am thankful for all the tips and hints.

I found a solution for my problem,

Since Love is more important to me than anything else, I have decided to close all my businesses, lay of all employees and sell them, i can't wait and waste 4 + yrs for my life to continue, I rather go back to Germany or to mongolia invest my money into their economy and be happy with the person I want to call my wife and have a family.

So long USA.

E2 DEPENDENTS / FAMILY MEMBERS

Spouses and unmarried children under age 21, regardless of nationality, may receive derivative E visas in order to accompany the principal alien. Family members may be students in the US while remaining in E2 dependent status and spouses may apply for work authorization with the USCIS.

this single reference does not remark on whether the marriage must exist before the initial entry, but i assume that it need not.

Final thought...

if you can file for USC after another year - then i suggest to go that route.

in the meantime, get back to mongolia, marry her, then file I-130 the day after you have your certificate.

hopefully, by the time the I-130 petition winds through to GUZ, she'll be qualified for the IR-1 visa, then ya gots 10 years of 'no uscis involvement'.

but hei - if she can get e-2 derivative status, suggest you go back to mongolia, marry there, then file your paperwork whilst still in E-2 status (perhaps theres more speed there? )

The terms "follow" and "join" make me think that the relationship must be present at the time of the visa issue. That being said, it is definitely worth the time and a couple of bucks to get a good immigration attorney's input. This could be OP's solution.

There are about 30,000,000 chicks here in the US that would probably fit into your "potential spouse" category and--as a nice side effect--could help you in your own immigration efforts, and you bump into a chick from Mongolia on her way home to one of the worst hellholes on Earth.

E2 in a non immigrant visa.

As far as UK applicants are concerned it seems mainly to be used by those who are desperate to move to the US, usually Florida, and buy the sell from unscruplous realtors etc etc.

It can be renewed indefinitely, it has no direct path to a GC. Children age out at 21.

Spouses can obtain a visa in the same sort of timescale as a B2.

Usually a first visa is given for 2 years, renewals for 5 assuming the business looks solid in both investment and employee numbers.

It has been called the visa from hell, but that is more down to a lot of people using it as a visa of last resort with marginal business's.

Anything specific to the OP's case I will leave to him to post. Or not.
