Hello everybody,

I really could need some help and advice and I hope to find it here.

Here is my situation.

I am a german with a E-2 visa. My mother a US citizen is applying for my green card within the next couple of weeks.

I know that this takes approximatly up to 4 yrs for my green card.

My fiancee is mongolian, we met in the US, she was a student on a F-1 visa, now she is back in mongolia.

What is the best and fastest way to bring her back to the US, how long will it take, what are my options, etc.

Thanks to everybody that has some tips or advice for me.

Hi Robert,

This is a little out of the norm for us here in this forum as we discuss visas for spouse of US Citizen, but there may be some more detailed help in the forum for bringing family members of permanent residents. Permanent residents cannot petition for a fiancee but can petition for a spouse. Expect the process to take about four years from filing to visa interview. The timeline may change.

I heard that it's very hard, nearly impossible for her to enter herself, like I said she was in the U.S once before on a F-1 visa. Could she come on a visitorvisa?

What if my brother which is a US. citizen applies for a K-1 fiancee visa for her, then when here, I marry her, can she stay here, while filling for her E2 visa for spouse?

Would that work?

I found out that if my mother changes the petition it will be from a 4 year wait to a 7 year wait!?

Not unless your brother plans on marrying her.

Could she come on a visitorvisa?

Yes, but she will likely not get into the country on such a visa if her intention is to marry and stay in the U.S. (adjust status) unless she lies on the visa app or at the POE which is a crime (i.e. do not do that).

Seriously? You want your brother to commit visa fraud (a crime) by representing your fiancee is his so you two can get marry. This is a really quick way to screw your brother and your fiancee over. She is not going to get to stay. You cannot benefit from immigration fraud when it is very easy to determine that your brother petition for her as his fiancee and then you married her.

If you want to immigrate to the US, there is nothing you can do to get your fiancee a visa right away. It takes an LPR about 4-5 years to petition for a spouse. The system is not going to bend to accommodate you. The immigration system does not allow new immigrants to bring more people into the country immediately. Otherwise, we would be overrun by new immigrants that we could not absorb into our social/economic structure.

NO, that is visa fraud, not acceptable and not allowed! The K1 visa is a fiancee visa that allows the beneficiary to come to the US and marry the person who petitioned him/her. Your brother cannot petition your fiancee so you can then marry her once here. Nor can you she use a tourist visa to enter the country with intent to emigrate...that's also visa fraud.

You will either marry her now and your mother changes your green-card petition, or you'll have to wait until you're a green-card holder, marry her and petition her as your spouse. Either way, you're in for a bit of a wait as dependents of residents take longer to get visa numbers issued than those of US citizens.

you've got a hard row ahead of you, timewise.

i suggest the two of you BOTH move to singapore. then you marry her in singapore, file for her GERMAN paperwork, then move back to germany. work for a few years in singapore in the financial district - usually an expat (of Germany ) can get work there.

OR

YOU MOVE TO MONGOLIA, teach english or german at a school there , marry in mongolia.

I really think that for the TWO of you to be in USA together, with legal status, is gonna be troublesome, at least in the short term.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

You come to the US. Then after being here, I think 5 years, you can become a naturalized citizen. Then you can apply for a K-1 visa for her.

Whatever you do don't have your brother file a K1 for her. That means she would have to marry him. NOT you.

At this point, it's a long wait for the both of you to be in the U.S. together. At the very least 6 years.

You can either marry and have your mom change the petition.

Or you can wait till you have your LPR status and marry, then petition for her as your spouse. I believe LPRs can not file for their fiance(e). Only USCs can.

Well thanks so far for all the responses, ok so my brother getting her here is out of the question.

Since I have been here since 4 yrs now, I can't just leave, because I own a couple businesses here which I need to run and manage, thats why I have a B2 visa. Moving to singapore or mongolia will not work because of this. I can't be without my girl for so many years. So you are telling me even with my E-2 visa and me being here for 4 yrs now, if i wait 1 more yr then I can apply for my citizenship??? Why does it all has to be so darn complicated!

Your mom hasn't applied for your GC yet? That'll be a good 4-5 years before you get your status. If she changes the petition, it'll become 7-8 years, I believe. That's another 4-5 years.

Yes I run My own businesses here. E-2 is a business visa.

So marry her and bring her in on an E2.

Ignore the other replies, they do not have a clue.
