amended tax return..interview

My husband will soon appear for IR-1 interview.

Eventhough I got married at end of Dec 2008, my accountant filed my tax return as 'single'. I didn't realize at that time it as a mistake.

I sent same to USCIS and NVC and all was approved and NVC says all is fine.

However sensing trouble during interview, it is my pure imagination though, I have filed an amended return as 'married, filing separate', paid dues to IRS, I want my husband to take it for the interview.

My question is:

Can he give the new tax return to pre-screener voluntarily along with Medical .. I guess these pre-screeners make list for CO. They may not ask my husband. If he wait till CO to ask for it, CO may not accept it rightaway and eventually it may delay process (or may not).

As I said either NVC or USCIS didn't ask for it. But embassy staff can find it.

Suggest me if I am inviting any trouble by voluntary offer or should my husband wait till CO ask for it, if at all they find.

Sorry - it was 'accepted' - not 'approved'.

The ConOff at the Consulate makes the final decision on interview day.

with that said,

Prepare updated I-864, include the updated tax returns - get it to your husband.

then.

tell your husband to say -

I have updated I-864 .

They SHOULD take it, either at the screener or the IO.

As someone working in the accounting field. Filing single and married filing separate are the same deductions they take. Really does not make a difference. I would not worry about this. Seriously, you did not even have to do a amended return, but that was your option. They are not going to question at all.

Yes stick with what you started with, if they ask for recent material or ammended forms then provide. This will not be an issue. Goodluck.

I would stick with the original ones, and all well be fine. As long as he has the W2's. No need to voluntary provide information that has no relevant to their decision.

sorry, my bad - i gave you bad advice.

really - to file 'married filing jointly' and then submit that as part of the I-864, should be 'the best' way to go.

it requires an extra step of getting a TIN with the W-7 form, and paperfiling to a special address in Austin.

as for 'married filing seperately' - i've no idea if it will help on interview day, but good luck, nonetheless.

I can't file a joint return as he has no ITIN or SSN, we have not applied for one yet also because he earns in India. I would like to file another amended return, appropriately, after he arrives here. He has income in India, but none in US, never been to US.

Whole idea is to say 'I am married', hence I can not say 'single'
