It is the fact he entered illegally that is the biggest problem to you. Many people have entered with a visa and over stayed and worked and gotten their status adjusted. Are you sure he came without a visa ? I have heard of a lawyer in Texas that specializes in central/south American visa troubles like yours. Laurel Scott is the name.

This will not be over quickly. You will not enjoy this.

The majority of people on this board have zero tolerance nor compassion for immigration-related violations. For that reason, I advise you to take your specific case to immigrate2us, as the people on that board are extremely focused on similar cases like yours.

As has been said before, your friend's primary problem is that he entered without inspection. The term for that is EWI. Unless he has come in contact with the law, or paid taxes, or is on Uncle Sam's radar, he doesn't exist in the US as they have no record of him being here. No record -- no status to adjust from.

I simply assume he came in without being caught, most likely by car, and -- purely theoretically, of course -- could leave the same way. If he leaves "on the record," the 10-year ban is triggered; if he leaves undetected the same way he got in, the EWI problem would be gone. The problem is, leaving without inspection is also illegal, so that would not work in his case.

Would he live in his country, however, and you visited him there afterward, you could continue your courting, get eventually married there, and then, once you are back in the US, can file a petition for your husband and the father of your child. A few months later, he would receive his spousal visa, and could enter the US legally and become a resident. There is one caveat, however, and I don't need to mention it, since the aforementioned won't work for your friend anyway.

Now, in order to be on the record, I strongly advise your friend against doing anything illegal. Probably redundant, as I'm sure he doesn't want to do anything illegal, nor do you. Thus, the aforementioned was purely fictive thinking on my part, only written down for you to understand why it won't work.

Again, we here on VJ have no tolerance for people who entered the country illegally, nor for people who want to help somebody like that. Pregnant or not.

Okay heres my situation..I met this guy and we started dating fell in love with him weve been dating for almost 4 years..and this past weekend he proposed and I said "YES" Heres the problem: He's Illegal! He came over here and has been over here for almost 5 years and I want to marry him and help him get his papers. Another issue I found out I'm pregnant by him which were really happy about but now I'm worried about him not being able to get his papers! Please help me! I want to know if theirs a way I can get him to get his papers. He came over here to work and send money to his family in his country because they were living in poverty.. He has never got caught over here and been deported back..he's stayed out of trouble and he is my world. Please help. Sorry this was so long.

Because having a high likelihood of being a single mother is something I would be trying to prevent.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

As john_and_marlene quoted: there is currently no path for him to become legal without first leaving the US and coming back legally.

For those of you who think what he did was wrong, seriously get a life, he did it already and did it for a good cause so now isn't the time to judge. Advice was asked for not criticism!

If u marry him it won't make a difference now; right now there's no way out for illegal immigrants who entered illegally. I know this for a fact and personal experience. All in all, you have 3 options:let him stay and pray he doesn't get in trouble w/ the law; let him go home, wait ten years and you try filing for him, if you choose this option, it'd be better to get married then send him home; and lastly sit and way for some sort of immigration amnesty to be passed.

IR5FORMUMSIE: yes what they did was wrong, I'm sure they know that by now. However, if and when you're in love chances are that you're so caught up that you barely think. As to your statement about other people having their loved ones back in their country, it's hard to do so. My fiance is in Jamaica and I travel there 4 times a year just to see him; we filed for a k-1 and is awaiting our approval.

Your best bet is for him to go to back where he came from and then wait out the 10-year ban. There is ZERO chance of AOS from EWI. Not gonna happen, lady.

If you love him as much as you say you do, surely you can move to his country. After all, you ARE carrying his child. What's a job compared to the love of your life and the father of your child-to-be?

You might think what he did was noble for his poor family but what matters is what the government thinks. You admire his courage for going to commendable lengths to help his family. Would feel the same if he stabbed someone and stole their jewellery? You know, to help his poor, starving, desperate family? What about if he robbed a bank? You know, going to any lengths possible? Other illegal activites but done with the noble intention of helping out his family financially?

You don't have to like the law, you just gotta follow it.
