Since you intend to get married, presumably here in the US, I'm curious why the attorney only offered advice on a K-1/Fiancé visa. Often one of the first things we hear attorney's offering is 'get married, stay and adjust status' or something to that affect.

What is the country of origin?

Talk to another immigration lawyer. I knew some people who had the same situation as yours and they were able to arrange their papers without leaving US. Hope you find a good lawyer =)

True for someone who overstayed a visa, or other legal entry to the US. Not true for someone who entered without inspection. There are only a couple of ways for someone who entered without inspection to adjust status while in the US. One way is if they were physically present in the US on December 21, 2000, and had an I-130 filed on their behalf before April 30, 2001. Obviously, this doesn't apply. The other is if they are the abused spouse of a US citizen. Again, doesn't apply here.

OP should be advised that if she marries this individual and he claims abuse, then he could get a green card, and she could get a criminal record. Caveat emptor...

Since your significant other entered without inspection, he cannot adjust status from within US borders. He has to go back home, file for a visa --- said visa will be denied and a ban faced. Then, you file a waiver. If waiver is approved, it's all good; if not, he waits the ban back home and reapplies when the ban lifts. If waiver is denied, you can always move with him to his home country for a while.

I've said this before: this is not a matter of justice, of fairness, and never ending love. It is a harsh and expensive process, with rules, procedures, regulations and nasty nuances. It is invasive of one's privacy and grueling for most people who face it separated. We don't have to like it or agree with it; but you can be sure we'd better follow it to the "T". To do otherwise affects you in a bad way.

I don't think what he did was wrong..He came over here to make money to help support his family in his country and he was planning on sending money to his family to build him a house over there..he never expected to meet me and fall in love with me in a million years nor did I. but everything happens for a reason.. and as far as me moving to his country that is out of the question..I have a great job that I love and all my family is here..

What you think doesn't matter. What matters is what the government of the country he wants to belong to thinks.

This is what I like to call, "Dealing with the consequences of your actions"

2) Stay illegally and get married - hope he isn't caught by the authorities

3) Stay illegally and wait for the U.S. government to provide another blanket amnesty to illegal aliens (which I personally, and many others, will protest.

Of course what he did was wrong. He came to the United States to make money illegally. He knew he couldn't legally work in the US but he did so anyways. That he fell in "love" is irrelevant. You seem to be in "love" yet you won't go to the ends of the earth for this man, apparently you love for your job is more than you love of your man. Now you expect us to condone this behavior, there are lots of people who are in love and have loved ones waiting overseas. Many have left the US and applied from their homelands and are waiting patiently. Some have even dealt with bans. While most of us feel for you, do not expect us to sanction such behavior, alienating the many helpful posters via vituperation serves no useful purpose. You have been given the best advice available without legal consultation, what you choose to do with it is your decision.

Okay heres my situation..I met this guy and we started dating fell in love with him weve been dating for almost 4 years..and this past weekend he proposed and I said "YES" Heres the problem: He's Illegal! He came over here and has been over here for almost 5 years and I want to marry him and help him get his papers. Another issue I found out I'm pregnant by him which were really happy about but now I'm worried about him not being able to get his papers! Please help me! I want to know if theirs a way I can get him to get his papers. He came over here to work and send money to his family in his country because they were living in poverty.. He has never got caught over here and been deported back..he's stayed out of trouble and he is my world. Please help. Sorry this was so long.
