Okay heres my situation..I met this guy and we started dating fell in love with him weve been dating for almost 4 years..and this past weekend he proposed and I said "YES" Heres the problem: He's Illegal! He came over here and has been over here for almost 5 years and I want to marry him and help him get his papers. Another issue I found out I'm pregnant by him which were really happy about but now I'm worried about him not being able to get his papers! Please help me! I want to know if theirs a way I can get him to get his papers. He came over here to work and send money to his family in his country because they were living in poverty.. He has never got caught over here and been deported back..he's stayed out of trouble and he is my world. Please help. Sorry this was so long.

I suggest getting an immigration lawyer after you get married, to help you file AOS. This is a big big mess, hes been living and working illegally for to long its likely going to be very difficult.

Agreed.... an immigration lawyer is going to be your best bet.

We got a cheap first consultation with a lawyer for 1/2 hour. You might want to get a couple of opinions just in case you go to a lawyer that doesn't know what he's talking about, which doesn't seem to be too uncommon from posts people here on VJ have written.

Well here's what worries me.. I talked to an immigration lawyer over the phone today and she said there is no way he will ever be able to get his papers because he has been over here for over a year illegally. She said if he goes back to his country and I apply for the I-129 Finance Form he will wait 5-6 months or more over there and then he will get denied because he will have to serve a 10 year penatly which means he will not be able to come back into the US for 10 years!! because he has been over here for more than a year illegally.. She said even if we got married over here and i'm pregnant it doesn't matter. That I would have to have some kind of disease that his country could not treat or a child w/ a disease inorder for him to come over here legally and avoid the 10 year penatly. I was just wondering if any one has gone threw this or knows some one who has who could help us because theres got to be a way around what she is saying! Please Help...sorry again for writing so much.

Talk to a different lawyer if he leaves there will be a lot more trouble and waiting and more costs. He already will have a 10 year ban if he leaves the country.

Talk to another immigration lawyer. I knew some people who had the same situation as yours and they were able to arrange their papers without leaving US. Hope you find a good lawyer =)

I'm the guy who says never use a lawyer unless it's the last resort.

This is one of those times.

Best of luck - you don't have to commit to the first one you interview,

and they should give you a free first consultation.

Don't feel guilty about the free part, those minutes will be included in

the billable hours after you sign the attorney-client contract.

Wow thats a tricky one. I would get a lawyer and have them assist you in this matter. I believe it is way to big for you to take on by yourself, frankly I don't think you alone would be successful. Good luck!

-Yes he entered the US illegally :(

Then there is currently no path for him to become legal without first leaving the US and coming back legally.

I don't think what he did was wrong..He came over here to make money to help support his family in his country and he was planning on sending money to his family to build him a house over there..he never expected to meet me and fall in love with me in a million years nor did I. but everything happens for a reason.. and as far as me moving to his country that is out of the question..I have a great job that I love and all my family is here..
