Visitors visa before a K2 visa

Hi everyone,

Can a visitor's visa ( b2) be issued for a k2 reciepient? For ex., I would like my fiance's daughter ( from Jamaica) to come visit the US before she moves here permanently via the K2 visa?

~ 4/22/09 - sent I-129F form off to VSC

~ 11/23/09 – Interview Scheduled 11/23/2009

~ 12/09/09 – Picked up visa at MoBay DHL ofc-EXTREMELY late processing

~ 12/13/09 – Arrived at Philadelphia airport

~ 2/14/10 – WEDDING DAY FINALLY

AOS Timeline

~ 2/26/10 – mailed AOS/EAD/AP via USPS confirmed delivery

~ 2/28/10 – delivery confirmed 6:57 am

~ 3/10/10 – rec'd email acceptance confirmation from USCIS

~ 3/16/10 – rec'd NOA1's via mail for I-485, AP and EAD

~ 3/19/10 – Biometrics appt - 3/31/10 11 am

~ 3/24/10 – Walk-in Biometrics appt - 2:00 pm

~ 4/07/10 – Case transferred to National Benefits Center

~ 4/09/10 – Case transferred to CSC for processing

~ 5/01/10 – EAD card ordered rec'd notice via email

~ 5/07/10 – AP rec'd in mail...no notice at all!

~ 5/24/10 – EAP rec'd in mail

~ 6/02/10 – AOS card ordered rec'd notice via email

~ 6/08/10 – rec'd welcome letter in mail

03/27/2009: Engaged in Ithaca, New York.
08/17/2009: Wedding in Calcutta, India.
09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony

tourist visa issuance eligibility is the same... if she qualifies (overcome presumption of intent to immigrate), then one can be issued ... if she does not then one will not...

Hi Sachinky,

Actually I'm being hopeful and thinking ahead. I'm hoping my fiance will get his K1 visa shortly and we've added his daughter on it to follow him to the States. She's 11. I'd like her to visit sometime shortly after he gets here but she won't be immigrating until we get settled etc...

I was just wondering if since we have listed on K1 would we be able to get a B2 for her before the K2 was issued.

no, eligibility requirements for a tourist visa are the same with or without any petition filing in process... however, the threshold of overcoming "intent to immigrate" may be more difficult to overcome, but that is strictly a consulate decision...

Based on your later comments, NO. Since she is listed as a K-2 derivative, that will be the next visa that will be issued.

Why would you want her to come beforehand, before she immigrates with the K-2?
