hello everybody , i have a few questions, hope you can help me.

i call a lawyer to ask her how much will cost all the process and the price was ....well it was expensive, and i heard that sometimes its better not hire a lawyer, i dont know what to do, how much cost all the process for the k3? and how long does it take? ist better to hire a lawyer? please i need some advice. im new on this and..im very confussed. thanks

most here do it without a lawyer. a lawyer will slow down the process. cr1 is a better visa, takes about the same time. if you do not have an overstay, or other red flags, you should do it on your own. either way you should become familiar by studying the guides!!!!!!!

CR-1 doesn't take about the same time. Stick with K3. MUCH BETTER! I sent my documents to NVC 25 days ago, they still say its not in the system. #######!

so its better not to hire a lawyer, but how much it cost ? the lawyer told me that i have to pay $ 2500 , thats expensive, so..how much it cost if i do it by my own ?

It is not a matter of 'is it better' to hire (or not hire) an attorney. Whether you should or not depends on your particular circumstances (which we don't know) - most folks on VJ do so without, some do it with the assistance of an attorney (some have had lawyers but wished they didn't after all while others didn't and probably should have from the beginning).

It's expensive (certainly not cheap) but not as expensive as it would if you paid someone to do it all for you (especially if you don't have any legal issues). If you want to do it yourself - you can investigate how the process works by reading the Guides found here on VJ.

Start with What Visa Do We Need? so you can compare the different spousal visas then follow the appropriate step-by-step guide.

There are flowcharts in the guides to give you an overview of the process - how long each step typically takes, etc.

me and my husband preferred not to hire a lawyer because it is really expensive..they will slow the process.. you can do it..just follow the step guide..

Hi, that would be on you rather you wanna go with a lawyer or not. I didnt just because for 1 my marriage is true not a scam and plus the lawyer charges are just to much. I hear with a lawyer its faster but how true is that.

Here is my situation which by the way i was new at this to but everything i needed to know i googles and would read what other people experinaced.

My husband and I married in April. But because we were not so good with money we filed in July. I filled out all the apps by my self and things i was not sure of i would google it. Just write the exact question on the app on google and you get your answers. I did call USCIS to see what apps i need to fill out and do fill out the app for advanced parole which is for traveling while waiting for the green card.

Anyhow, we sent in everything in July. 2 weeks latter we received receipts in the mail for each application filed. In August my husband received his bimetrics appointment letter and at the end of Agust his work authorization card. Also in August he received a letter for his interview that was sheduled for September. At the interview, that went well i would say the only thing the officer wanted from us as additional document was a letter from my mom confirming we live with her. Mind you we didnt even take any photos which is my fault for that. I should of prepared more stuff for the interview.

And yesterday, we just received an email that told us his green card is ordered and will receive it in the mail. :)

Which i am happy about because now we can go visit back home.

Anyway i wrote all this just so you know how long what takes.

Also, before you file do call USCIS, explain everything to them your situatio and make sure everything they ask you is true as it does matter what apps you need to fill out and send. I would also call a few times to confirm the info they give you because once I called one person i spoke to gave me names of some different forms. So call a few times to confirm. Also if anything is confusing on the app google the question. Another thing is read the instructions for each app. because each app needs to have additional documents attached. It takes six to eight months if done efficiently. This webpage does a good job of laying out the government fees and when they are paid.

I too recommend the CR1 visa path over the K3 in almost all cases but both K1 and CR1 fees are shown on the page. K3 overall is $100 less than the K1 on the first fee and the rest are the same.

Facts are cheap...knowing how to use them is precious...

hi thanks you for your help. well im from Peru and my husband is from USA, im the one that needs the k3, we dont know what to do, seems like for you all the process was fast, thaths really nice.

we were thinking to hire a lawyer because he is in usa and im in peru so...we dont know how to deal with documents and ..forms... i think if we were together would be better but...its not possible. anyways..we dont know if do it by ourselfs would be better. it is too complicated? i mean the process. and it is too expensive? and what about de biometrcis?

You are describing an adjustment of status process, not a spouse visa process. They are not similar. Any comparison would be misleading.

My wife and I did the CR-1 visa. It took 6 months to that day. We didnt use a lawyer. In fact I called several lawyers most wanted my money any where from $1500 to $2500. Then I talked to this one he says to me you dont need a lawyer if you dont have any legal problems. He was right. We got no RFE's had no delays.

You will have to read the guides to be sure what is best for you. Unless the K-3 process has gotten faster the CR-1 times will be about the same. If the beneficiary enters on a CR-1 it will be cheaper in the long run. Also upon entry the beneficiary will be able to work and get a drivers licence and a social security card and bank accounts ect....

If you can fill out basic government forms (ie.. taxes ect) by your self then you shouldnt have any problems doing the immigration forms. Most of it is what is your address where do you live where have you worked blah blah blah. You would have to give that info to the lawyer any way. Why not just put it in the proper place on the paper your self and save a few thousand and use th money to go visit your spouse or go to the interview ( a much better spending of your money in my opinion). Showing up for the interview would do you much more god than a lawyer would do you ( unless you have some kind of legal immigration problems)

The best thing you can do to make the process work well is be thourough check every thing several times make sure it is right and that you are doing it the way they are asking for it. Prepare for the next step ahead of time dont wait to work on the next step when you get the go ahead. When you do get the go ahead you can immediately send it in because you have already filled out the forms and collected the information and evidence that you need.

I found that the most time consuming part of the entire process was the information gathering and making sure it was correct. The actal filling out of the forms and sending it in took very little time.

Like the guides say make 3 or 4 copies of every thing dont send originals unless they are specifically asked for.

So when you are ready to send every thing in you will have say 3 or 4 stacks of exactly what you are sending make copies of checks and every thing. If some thing gets lost you will have it readily available to send it in that day and not have to go searching for the info all over again.

Also just so you know only the US citizen can do the application for the immigration papers. Although you can have a say and help fill out the forms ultimately its the USC that signs and sends in the forms. Its only later in the process that the beneficiary is involved in thier part of the form filling.

Did you get married in Peru or in the United states? IF you got married in Peru and went through that process on you own then you shouldnt have any problem doing the immigration papers on your own.

Make VJ your best friend during this process ask alot of questions most are very happy to answer and dont genrally lead you astray. The forms are ( CR-1) I-130 filled out by the USC I-864 filled out by the USC or co sponser it goes through USCIS then to the NVC then to the Lima consolate from there the beneficiary gets get the DS230 which the beneficiary fills out some where in there is the DS3032 which is to be sent in by the beneficiay but it can be emailed and if done properly can be doen by the USC. I USC filled out the DS230 for my wife ( with her information) and then emailed it to her. Its all in english so it was easier for me to do then she signed it.

As soon as the NVC gave us notice that her file had been sent on thoe the consolate she started the procedure of getting the police reports whcih you can only get in Lima. If you do your home work you will know what is going to happen before it happens and is asked for and can speed up the process significantly.

Yes that is true I did describe the AOS. But the thing is my husband could of come on the K3 visa but I knew from friends experinace that it can take up to around 6 months.

I went with him while visiting in my country to the American Embassy for him to get a tourist visa. I knew IF he gets a tourist visa he can come right away. And that is the way he came here, and yes there was a chance he would not get it.

I took this route just because we did not want to have a long distance relationship and I just did not want to be a day with out him. All of you know how that is right? Very hard!

Anyway, this is my advice: Have your husband research everything regarding the K3. And like I said before, have him call USCIS about the needed forms and everything else that is needed to send with the forms. As long as he is an American Citizen everything will be ok. See a friend of mine has a green card and he has to wait until he becomes and american citizen to bring his wife. So sad.

You are describing an adjustment of status process, not a spouse visa process. They are not similar. Any comparison would be misleading.
