can my husband file I-130 in us embassy manila

hi!! hope u can help us! me and my husband have been living together here in manila for more than a year before we got married here in the Philippines as well. He is an American citizen and He is not a resident here yet but he have been filing his visa extension here every 2 months. Can he file the petition (I-130) in us embassy manila since we are both here in the philippines? if so what should be the first step? thank you very much

I'm not sure about the residence requirement for DCF - Direct Consular Filing - but if you do fulfil them, then yes, go ahead and file.

There might be a 6 month requirement. And proving domicile also becomes a big issue.

Check on the DCF boards.

I did the same thing...the answer is no...he needs to be a resident before he is allowed to file there in the embassy.

I also needed to come home to US to file the paperwork...it hurt. the wait is long, we finally got approved yesterday after 5 months and a few weeks.

Why doesn't your husband stay there with you, get his residency card then file, otherwise, he needs to come to US.

tyvm.. we've been living together for about 2 years now but we just got married last July. we will be processing his residency here next month. so if he would be a resident here in the Philippines he doesn't need to go back to US to file it right?i mean for the whole process he doesn't need to go back?congratulations to both of u.. i appreciate your reply
