Many Questions About Submitting

Hello All!

This is my first post here (and in the CR-1 section) and I have much to ask about. I have an appointment at the embassy next week to submit my I-130. However, there are a few things I am not sure about. I hope someone here can help me.

1.) Can I file the froms I-485 and I-765 with form I-130 if I file them all together with the form I-824??

2.) If I can submit them together, what do I write on I-765 where it says "current visa status" and I-485 for visa issue date?

3.) On form G-325, the year boxes have 0000 inside them. How am I supposed to write a year clearly with these graphics interfering with the view? Can I white them out?

4.) If I recently was married and have not started to use my married name (having not submitted anything to the government), should I use my maiden name?

5.) In general, how does the petition work with I-485 etc.? Can he enter once I-130 is approved, then waits in the USA while I-485 is processing??

6.) All the medical tests will be conducted before he can come to the USA, correct?

7.) After all is said and done, THEN we submit I-751 and I-94 when he is in the country and a I-485 has been processed??

8.) For the joint sponsor on I-864A, do I need an original copy of their birth certificate? or is a photocopy alright?

Thank you ahead of time to anyone who can help clear up all this confusion.....

There is so much to do and it can be daunting.

Hello All!

Are you applying for both K3 and CR1 or just CR1?

1.) Can I file the froms I-485 and I-765 with form I-130 if I file them all together with the form I-824??

No, the I-485 and I-765 are for the adjustment of status process for a K3 visa. I'm assuming you are applying for a CR1, so you would not be doing an AOS. The I-824 isn't required until the NVC has approved your I-130 petition.

N/A, see above.

Why not complete the form on the computer? You can type over the 0000s.

If all your evidence (ID, bank accounts, pay slips, etc.) are in your maiden name, stick to it for petition purposes.

Once the CR1 visa is granted, your spouse can enter the US and won't need to AOS. If he enters on a K3, then he would need adjust. It all depends which visa you apply for/ get.

Yes.

7.) After all is said and done, THEN we submit I-751 and I-94 when he is in the country and a I-485 has been processed??

The I-751 won't need to be submitted until a maximum of 90 days before the expiration of his conditional GC. There is no adjustment of a CR1 visa, only removal of conditions.

8.) For the joint sponsor on I-864A, do I need an original copy of their birth certificate? or is a photocopy alright?

Not sure about this one. It's worth taking your time really going over the guides here and also reading the forums for both your visa/s and your region.

No, the I-751 is to be submitted 90 days prior to the conditional green card expiring. The conditional green card is good for two years, so look at the expiration date on the green card and count back 13 weeks on the calendar.

The I-824 ? yikes. That's a painful form to file. Do you really need it?

I thought the I-130 was enough, for DCF'd filers - but you'll need the DS-230 and the I-864 at some point.

for names - use YOUR name as it's CURRENTLY written in your passport.

He can enter as soon as the CR-1 visa is in his passport, and he has his passport in hand.

Then, he will wait 2 weeks to 45 days - the gc will show up in the postal mail to an address you've written in the forms.. (Be careful if you move, the green card is NOT FORWARDED in the USA ).

co-sponsers birth certificate - need original or certified copy (certification done at the issuing authority) - a photocopy isn't acceptable.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
