Hello All!

This is my first post here and I have much to ask about. I have an appointment at the embassy next week to submit my I-130. However, there are a few things I am not sure about. I hope someone here can help me.

1.) Can I file the froms I-485 and I-765 with form I-130 if I file them all together with the form I-824??

2.) If I can submit them together, what do I write on I-765 where it says "current visa status" and I-485 for visa issue date?

3.) On form G-325, the year boxes have 0000 inside them. How am I supposed to write a year clearly with these graphics interfering with the view? Can I white them out?

4.) If I recently was married and have not started to use my married name (having not submitted anything to the government), should I use my maiden name?

5.) In general, how does the petition work with I-485 etc.? Can he enter once I-130 is approved, then waits in the USA while I-485 is processing??

6.) All the medical tests will be conducted before he can come to the USA, correct?

7.) After all is said and done, THEN we submit I-751 and I-94 when he is in the country and a I-485 has been processed??

8.) For the joint sponsor on I-864A, do I need an original copy of their birth certificate? or is a photocopy alright?

Thank you ahead of time to anyone who can help clear up all this confusion.....

There is so much to do and it can be daunting.

k

I'm confused, you talk about submitting the I-130 at an embassy which indicates the USC and the beneficiary are overseas. Then you want to submit the I-485 which tells me both are in the US.

Could you clarify your situation a bit better please?

You should use whatever name you currently go by, if that is your married name, then put your married name. If that is your maiden name, then put your maiden name

Good luck.

If you the USC is in the U.S. and your spouse is her own country -- that is, you are separated -- then you need to file the I130 for a CR1.

If you're both in the U.S. currently, then you may file for AOS with the I485.
