thanks for the reply. I appreciate your help. is there anything you want to share about your interview? How was it?

If your police clearance is from another country and you have not been there since the letter was issued, it should be good. Of course you know you need the NBI clearance from the philippines. Good luck on your interview! I cant wait until we are at that stage.

Hi ! I have questions about police clearance too.

I worked in China for quite a while under tourist and business visa and I’ve read in one of the forums here that China doesn’t give police clearances to people that didn’t stay there without a working visa.

I’ve been back in the PI for 1.5year now and is preparing for my medical and interview.

What am I to tell the USEM about this? Should I provide them a police clearance here in the PI instead?

This is from the DOS site: http://travel.state.gov/visa/frvi/reciproc...ocity_3537.html

Police Records

Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories.

Police records also are not available for those who were in China in diplomatic status including those working for international organizations such as the United Nations. Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate. This is the case for persons sent abroad for education by the Chinese Government who fail to return to China.

According to a 1957 state council ruling that is still in force, the imposition of a re-education through labor (Lao Dong Jiao Yu) term does not result from a criminal conviction. Administrative organs, rather than courts, impose re-education through labor. It is important to distinguish re-education through labor from labor reform (Lao Dong Gai Zao), which is a sentence meted out for criminal offenses

what was your visa catagory when you were there? Is there a chinese embassy in manila? Some countries they know that you cant get a clearance unless you apply there in person. When this happens and you are not in that country, they dont require it.

You need the clearance at the interview. Claudeth had a German clearance and forgot to get it translated which ended up delaying her visa issuance by about 3 weeks.

I used F and L visa. The company I worked for couldn’t get a working visa for us because China government has got a different standard when it comes to issuing Z visa to small companies like what my boss has.

I’m getting really worried because now I know that I wouldn’t be able to get that clearance :(

If you stayed in China for more than 6 months, then, you must get a police clearance. Try contacting the Embassy of China and ask them what to do.
