I got married June 2008 and my wife was schedule for an interview and she was denied due to lack of evidence of relationship.

Now that my file is being sent back to USCIS. I don't know what to due at this point. I was told that i will have a chance to appeal with USCIS but the lady who does my Visa told me don't bother. Just start a new one. Well i am concern because restarting eveything will take another 8 months.

Any advice?

Is Evidence really that important. I believe i had more than enough evidence.

I saved my phone bills, airplane tickets, pictures, even got married in a church. I mean what can be Fake?

VISA is being way to strict. Just that i have school i didn't go back to visit my wife in a Year nor did went back to vietnam during her interview does not grant the officer the right to refuse a K3 Visa.

We are married? what else do they need? I believe a marriage is what the person say it is.

Are there any laws out there to protect our rights?

It seems who ever getting married in vietnam can be victims now.

I don't want to end up in a divorce due to the officers mistake.

Vietnam is a high fraud country, so unfortunately for those couples who married for love have to jump very high hurdles.

You need to contact an experienced immigration attorney and have them request the consulate to keep the file - you do not want it going back to Washington DC!!

Could you post a list of questions that were asked at the interview? And a detailed list of the evidence submitted?

Did the interview go well or did something happen during the questioning?

12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

Vietnam is a high fraud country so things are stricter there. There are no laws to protect your rights because you do not have a right to bring your wife to the US - it is a privledge.

You'll have to overcome the reasons for denial, if not visiting in a year was a problem, you'll need some more visits before you reapply. What were the reasons for the denial?

Contact an experienced immigration attorney quickly to have the file kept in Vietnam

What went wrong at the interview, ie what questions could she not answer? How often have you visited (I know you didn't visit in the last year, but what about before)? When was the interview? If it was recently, do your very best to keep the visa app at the embassy, and request another interview, ideally with you there.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

At this point, I would let them go ahead and send the K3 case file back. Get your I-130/CR1 case moving through NVC and this time be prepared for the interview questions and have sufficient evidence of a bona fide relationship at interview time. Being there at the time of the interview helps. I don't think you allowed in the interview but she can show your passport to indicate you are there.

As others have said, HCMC is a tough Consulate due to high fraud levels. I would share nonpersonal case details either here or in the applicable regional forum for assistance in assembling evidence and interview preparation.

I concur with pushbrk on this one - kick the I-130 back into play, start the NVC process - give NVC a call today, inquire about the I-130, tell them you want to continue the processing.
