Hello All,

My Uncle petitioned his brother and 2 sisters who are in the Philippines. This is called Family 4 based petition. My Uncle is a US citizen. October 2, 1987 were all the dates written on the petition paper for his 3 siblings. A week ago, my Uncle received a letter from the NVC stating that the visa for his brother is now available and he has to start processing the AOS etal. My ques are:

1. As Ive said from the above, the 3 siblings have the same petition date. Why NVC only noted and processed at the moment his brother? What about the 2 sisters? Btw, one of the sisters petitioned there is my mother.

2. Since the petition was 22 yrs ago when he filed it, his brother was "single" (marital status) then. Do you think that was the reason why his petition paper was processed first?

3. Does my Uncle needs to download any form to change the marital status of his brother?

4. Can his brother take his wife with him once approved for visa?

5. Does my Uncle needs to download a form to include his brother's wife on the petition?

6. How long does it take for his 2 sisters to hear something from the NVC?

My Uncle petitioned his brother and 2 sisters who are in the Philippines. This is called Family 4 based petition. My Uncle is a US citizen. A week ago, my Uncle received a letter from the NVC stating that the visa for his brother is now available and he has to start processing the AOS etal. My ques are:

1. As Ive said from the above, the 3 siblings have the same petition date. Why NVC only noted and processed at the moment his brother? What about the 2 sisters? Btw, one of the sisters petitioned there is my mother. Each case is separate. They are not linked together. Some are processed earlier than others. However, all will be eligible for visas at the same time. Over the next couple of months, your uncle will get the IV bills for the other two cases.

2. Since the petition was 22 yrs ago when he filed it, his brother was "single" (marital status) then. Do you think that was the reason why his petition paper was processed first? Maybe. It could be that there was less paperwork to look through for him. If he is now married with children, your uncle need to contact the NVC to add his wife and children to the petition and pay all the fees, get medicals, etc. or they will not get visas or the case may be unnecessarily delayed.

3. Does my Uncle needs to download any form to change the marital status of his brother? YES. He needs to tell contact the NVC.

4. Can his brother take his wife with him once approved for visa? YES. See my answer to 1 and 2.

5. Does my Uncle needs to download a form to include his brother's wife on the petition? He needs to contact the NVC. A copy of the marriage certificate (translated into English) will be required. As far as I know, there is no form or online way to do this. Write a letter with the case number and other relevant facts (google "contact NVC" to see what is required) and include the copy of the marriage certificate.

6. How long does it take for his 2 sisters to hear something from the NVC? Anytime between now and when the PD becomes current. No one can tell you exactly when. Not even the NVC unless a letter has already been sent out.
