i m getting all paper work done to petition my husband but one thing thats putting down is i864 my annual income in low than poverty line but my husband been in us form 5 years and he have granted asylum and he been working here he still have work permit . so can i attach his pay stuff to show that we can support ourself since he works and we r married? plzzzz somebody who knows abt this plzz help me i m so confused .

From the I 864 instructions:

Can the Intending Immigrant Help Me Meet the Income Requirements?

If certain conditions are met, the intending immigrant's income can help you meet the income requirement. If the intending immigrant is your spouse, his or her income can be included if it will continue from the same source after he or she obtains lawful permanent resident status. If the intending immigrant is another relative, there are two requirements.

First, the income must be continuing from the same source after he or she obtains lawful permanent resident status, and second, the intending immigrant must currently live with youin your residence. Evidence must be provided to support both requirements.

However, an intending immigrant whose income is being used to meet the income requirement does not need to complete Form I-864A, Contract Between Sponsor and Household Member, unless the intending immigrant has a spouse and/or children immigrating with him or her. In this instance, the contract relates to support for the spouse and/or children.

So, my reading says that they do not use form I864A, so they must use I864?

Definitely include a cover letter which explains the situation and quotes this portion - if they want something extra they will send an RFE.

You may want to ask to have this thread moved to the forum for people adjusting from other than family based visas as there will be more people who are in this situation and can give you specifics on which form to fill out.
