Request for more evidence

I am so glad we joined this bc we are stressed! My husband and I filed for I751 and received a letter last week to submit more evidence that we have a bona fide marriage.

We submitted: joint tax returns, life insurance policy, some pictures, travel receipts and joint bank account statements and 2 affidavits.

So what now? My husband is a student and I am on everything we own pretty much. I am a veterinarian so my income is what we use currently.

We are trying to get him on our lease and that is becoming a problem.

We have 5 more people writing affidavits, have gotten a ton of pictures together from before when we dated til now a course of 7 years worth. Such a change in what we look like is too funny what married life does to you. Plus more receipts, an amazon account, anniversary cards and wedding invitations with both our name and address on them with post marks. Now do we send all this bc we really have nothing else.

Plus we thought if we wrote a joint letter? They would know in 2 seconds of an interview that we were married. What more should we do, we have til Dec 17th or actually before that bc it is due then. Does it look bad to try and add him to things now? Thanks for the thoughts!

(hopefully you also sent GC copy front and back)

Yes, should send what you got, pics and affidavits are good

Any of these could help:

driver's licenses showing the same address

any utility bills in either of your names

car insurance, do you have one?

write a statement about why everything you own is in your name (I assume this may be what ticked USCIS off)

go for a weekend getaway somewhere and provide hotel receipts/photos

current bank/credit card statements in both your names

are you listed as emergency contact for your student spouse somewhere?

State taxes in addition to federal taxes,

Bon courage!

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

Welcome to VJ.

Without seeing the exact wording of the RFE I'll kind of guess what it says (is requesting).

The lease is pretty important - living together is a good indicator. Am not sure why he's not already on there (but it doesn't matter now) - I can imagine it would b difficult to add someone to a lease already executed - perhaps an addendum could be drafted. You know the details behind this, we don't.

Things I've suggested in the past:

  • Driver's licenses - if you both drive, you both probably have the same address on the DL. A copy of each.
  • Utility/Cellular/Internet/Other bills - even if not joint accounts - both are likely getting them mailed to the same address. Copies of those.
  • Junk mail - it never seems to go to a place you've never lived (it'll go to a place you've lived before, but I've never seen it arrive before you've lived somewhere) Especially any that say "Congratulations Newlyweds - here's your gift card/coupon"
  • School records (either of you) - probably list the same address
  • Gym/Video/Clubs/Organizations/Etc Memberships - probably list the same address
To name a few things to think about (some are/may-seem silly but maybe they'll jog your creativity; its a curious process to 'document' your relationship in this way, especially for relatively new relationships and sometimes you have to be creative). Am not sure more affidavits are necessarily the answers - can't hurt but chose people that can help, family, family-friends, etc.

I also used our pets' microchip registration showing both our names - if you have pets that might be something; our HOA residency list showing both of us at the same address - will the landlord write a letter stating you both live at the same address even if he won't add him to the lease?; copies of our wills; copies of AAA cards (same account); copies of Costco cards (same account); Emergency Contact information from my husband's work listing me as spouse and first contact name (does his student registration or enrollment list you as spouse and contact name?); health cards (same account); car registration with both our names; car loan with both our names; on the joint bank account statements I highlighted where the mortgage was paid from the joint account since I am not on the title or mortgage (that might work for you - a joint account with rent and household bills highlighted on the account - and evidence that he also uses that account); travel documents together; family cell phone plan with both our names listed; photos showing us with each other's families at holidays (ie. Thanksgiving, Christmas), any sort of evidence of packages delivered in either both your names or in his name to your address; etc. Make sure your documents cover the whole time of your marriage so you may wish to include more bank account statements covering the whole time of your marriage.

Think creatively - good luck!

He never was put on the lease bc I had gotten the place. He was working in Canada at the time and it was even before we were married. We didn't think of anything of it bc we want a house. From what the letter we received said it was basically prooving address for both of us.

We have been together for 7 years and married 3. So I guess we just need more evidence prooving that. I just thought it was of the 3 years but we have stuff we can go back and send as well. I would hope if we sent more evidence in we would be ok.

We live in NH and only have federal tax returns. We deal with the VT service center but have an office in Manchester, NH that we go to.

I'm on the same boat as you. We received a letter last month asking for more evidence. We sent them a statement from our joint checking account, dog vaccination form with both of our names, a letter my wife got from school about a federal student loan she took out, some travel receipts, water bill with both of our names and another copy of our joint tax return. It still left me wondering what would happen if they decide that's not enough either!!!

I hope they approve it soon because we can't even travel now that her visa is expired. I was hoping would could go to the Dominican Republic for Christmas to visit her family if she got her green card in time, but I doubt that's going to happen.

Seems like both of you are missing lease one of the key evidence for USCIS. My OPINION is when you sent a copy of lease of some statement from the people you are staying with, you shouldn't have any further problem...

I'm confused with the bolded statement. Why can't you travel? She is lifting conditions on her green card, correct? When she received her NOA (1) there should have been verbage that the expiration of conditional green card was extended for one year.

Complete

I was approved today and I was not on the lease or any bill. I too was working in Canada till my green card was approved. I used drivers license showing we lived together and bank statements. I also had two letters from in laws and that was pretty much. I did not even send my daughters birth certificate. The two of you have to own something be it a bank account or credit cards, cell phones. Anything that shows both of you and address is required to establish that you live together.

Good luck it will happen. Canada is a great place to live too. I'm for one i'm thinking of going back.
