Timeline

A friend of mine brought his fiance on a K1 and they recently got marred. His fiance's son also got a K2 visa but didn't come with his mother as per their plans. How long does the kid have to use the K2 - I thought they have one year but she thinks only 6 months. Any experts out there? Thanks:

July 21 Interview in Bogota ** Approved ** Very Easy!

Oct 19 Mailed AOS Packet to Chicago

2006

Feb 17 AOS interview in Denver. Biometrics also done today! (Interviewing officer ordered them.)

Apr 25 Green card received

2008

Removal of conditions

March 17 Refiled using new I-751 form

April 16 Biometrics done

July 10 Green card production ordered

2009

Citizenship

Jan 20 filed N400

Feb 04 NOA date

Feb 24 Biometrics

May 5 Interview - Centennial (Denver, Colorado) Passed

June 10 Oath Ceremony - Teikyo Loretto Heights, Denver, Colorado

July 7 Received Passport in 3 weeks

Shredded all immigration papers Have scanned images

Doesn't take an expert - look at the expiration date on the visa. (It will be 6 months from the date of issue.)

"A K2 Visa holder (child of K1 Visa holder) may enter up to one year after the K1, but a K2 Visa holder may not enter the U.S. prior to the K1." This is from Visa Journey http://www.visajourney.com/faq/k1k2visa-outline.html Read step 3.

So, is it one year for the kids or they changed it to 6 months?

My son followed on with a K2 visa which was issued through London. A K2 can have their interview/medical to apply for their K2 visa up to one year after the K1 visa is issued, but then must use that K2 visa to travel within 6 months of its issue date.

My son followed on nine months after I came to the US. I had my medical in July 2004, he had his in March 2005 and travelled in June 2005.

Hope that helps to clarify things for you.

17 February 2004 Sent I-129F petition CSC - It was APPROVED in 147 days

3 September 2004 INTERVIEW IN LONDON SUCCESSFUL VISA APPROVED! MARRIED OCTOBER 16, 2004

ADJUSTMENT OF STATUS - 5 MONTHS

4 January 2005 - Submitted applications for AOS and EAD - 12 May 2005 Conditional Permanent Residency Approved - interview in Santa Ana

4 June 2005 CPR 2-year Green Card arrives in mail

REMOVAL OF CONDITIONS - 3½ MONTHS

8 May 2007 - I-751 sent to CSC - 23 August 2007 - Approved - Card production ordered

30 August 2007 - 10 year Green Card received

K2 TIMELINE (Stayed behind in UK to finish school)

28 March 2005 - embassy interview & medical London - visa granted

01/18/06 Applications for AOS/EAD sent - 03/28/06 EAD approved

4/3/06 - RFE for AOS - requested new medical and vacc supplement

4/26/06 - approved without interview and welcome letter sent

05/02/2006 - Greencard arrives in mail

03/14/08 - Petition to Remove Conditions mailed to CSC delivered - 7/2/08 APPROVED

NATURALIZATION TIMELINE (for myself and son) 5 MONTHS

April 18, 2011 - N-400 Applications Mailed to AZ lockbox

April 21 (received April 25) NOAs

May 12 - FP Letters mailed

May 16 - Received FP appointment letters for June 8 at 11am

August 1 - Interview - approved for Oath Ceremony - OATH CEREMONY 28 SEPTEMBER

That would make the faq incorrect or unclear at best.

I now understand the time frame to be

1) The minor children of K1s can apply for their K2 visa within one year of the K1 being granted

2) All K2s must travel within 6 months of the K2 visa being issued.

I hope this is in fact correct? Any other opinions?

The e-mail you received is correct. In certain circumstances, which the writer failed to mention. In fact, a K2 visa holder can enter as much as nearly 18 months after the K1 given the right circumstances.

The question you asked in your opening post was, "How long does the kid have to use the K2 ". And in any circumstance the answer to that question is 6 months, whether the K2 enters the day after the K1 or 18 months after the K1.

No - a K2 visa must be issued within 1 year of the issuance of the K1.

Therefore everything prerequisite - application, medical, even the interview - must be compled in less than one year. (You can nitpic the interview item if you wish, but visa applications cannot always be approved and the visa issued on the day of the interview - cutting it too close can be risky.)

Thank you for the correction/qualification of my statement. I was working on the supposition that if the K1 was approved the K2 would automatically be approved too, but I guess on reflection there are cases where that may not be so.
